OF THE COUNCIL OF THE CITY OF FORT COLLINS
ADOPTING THE REPORT OF THE DIRECTOR OF PUBLIC WORKS
ON THE ESTIMATES, COSTS AND ASSESSMENTS FOR THE
BOARDWALK SPECIAL IMPROVEMENT DISTRICT #77,
APPROVING THE DETAILS AND SPECIFICATIONS FOR
SUCH PROPOSED DISTRICT, DETERMINING THE AMOUNT
OR PROPORTION OF THE TOTAL COST TO BE PAID BY
A METHOD OTHER THAN ASSESSMENTS AGAINST PROPERTY
IN THE DISTRICT, THE NUMBER OF INSTALLMENTS AND
THE TIME WITHIN WHICH THE COST OF THE IMPROVEMENTS
ASSESSED AGAINST PROPERTY IN THE DISTRICT WILL BE
PAYABLE, THE RATE OF INTEREST TO BE CHARGED ON
UNPAID INSTALLMENTS, THE PROPERTY TO BE ASSESSED
FOR THE IMPROVEMENTS, THE METHOD OF MAKING SUCH
ASSESSMENTS, AND THE DATE WHEN THE COUNCIL WILL HOLD
A HEARING AND CONSIDERING ORDERING BY ORDINANCE OF
THE PROPOSED IMPROVEMENTS
WHEREAS, heretofore, the Council by resolution directed the Director
of Public Works to make a complete survey of the proposed Boardwalk Special
Improvement District #77, including the preparation of a map, plans and
specifications and an estimate of cost of the improvements in said proposed
district, and
WHEREAS, the Director of Public Works has made his report and has
presented the details and specifications for the proposed district
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS
Section 1 That the report, plans, specifications, map and estimates
as presented by the Director of Public Works for said district be, and the
same hereby are, accepted and approved
Section 2 That the following estimated amount or proportion of the
total cost of such improvements shall be paid by the City at large and not
by assessments against property in the district, to wit
Water Main Oversizing $18,876
Engineering for Street Oversizing 13,949
TOTAL 32,T25
Section 3 That the property to be assessed for the improvements
shall be those properties owned by the petitioners as set forth more
particularly on Exhibit A attached hereto
Section 4 That assessments for the cost of installing the improve-
ments in the district are estimated to be $138 90 per linear foot of
frontage
Section 5 That the following amount shall be paid to the City by a
participating property owner for certain water and sewer costs, pursuant to
an agreement with the City ($19,945 estimated) for the costs of installing
said improvements
Section 6 That said assessments shall be payable in ten (10) equal
annual installments, with interest on the unpaid installments at a rate not
to exceed eighteen percent (18%) per annum
Section 7 That on the 7th of September, 1982, at the hour of 5 30
PM, or as soon thereafter as the matter may come on for hearing in the
Council Chambers of the City Hall , City of Fort Collins, the Council of the
City of Fort Collins will consider the ordering by ordinance of the pro-
posed improvements and hear all complaints and objections that may be made
and filed in writing concerning the proposed improvements by the owners or
of any interested persons
Section 8 That the property owners affected by said district have
waived all notice requirements required pursuant to Chapter 16 of the Code
of the City of Fort Collins
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins this 7th day of September, 1982
