ADOPTING THE REPORT OF THE DIRECTOR OF PUBLIC WORKS ON THE ESTIMATES , COSTS AND ASSESSMENTS FOR THE LANDMARK SPECIAL IMPROVE- MENT DISTRICT NO 80, APPROVING THE DETAILS AND SPECIFI- CATIONS FOR SUCH PROPOSED DISTRICT, DETERMINING THE A OUNT OR PROPORTION OF THE TOTAL COST TO BE PAID BY A METHOD OTHER THAN ASSESSMENT AGAINST PROPERTY IN THE DISTRICT, TFE NUMBER OF INSTALLMENTS AND THE TIME WITHIN WHICH THE COST OF THE IMPROVEMENTS ASSESSED AGAINST PROPERTY IN THE DISTRICT WILL BE PAYABLE, THE RATE OF INTEREST TO BE CHARGED ON UNPAID INSTALLMENTS , THE PRO- PERTY TO BE ASSESSED FOR THE IMPROVEMENTS , THE METHOD OF MAKING SUCH ASSESSMENTS , AND THE DATE WHEN THE COUNCIL DILL HOLD A HEARING AND CONSIDER THE ORDERING BY ORDINANCE OF THE PROPOSED IMPROVEMENTS WHEREAS, heretofore the City Council of the City of Fort Collins, Colorado, (the "City") began proceedings to establish the pr000sed Landmark Special Improvement District No 80 (the "District" ) by the acceptance of the petition of M Rolle WalKer (the "Petitioner") , the sole property owner in the District and by resolution directed the Director of Public Works to make a complete survey of the District including the preparation of a map, plans and specifications , and estimate of cost of the improvements in said proposed District, and WHEREAS, the Director of Public Works has made his report and has presented the details and specifications for the proposed District NOW, THEREFORE , BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That the report, plans, specifications map and estimate as presented by the Director of Public Works for said District be, and the same hereby are accepted and approved Section 2 That the following amount or proportion of the total cost of such improvements shall be paid by the City at large anc not by assessments against property in the District to wit $470 , 800 for the street oversizing and storm drainage improvements on Prospect and Shields Streets , costs for other street and utility improvements to Prospect Street, and costs for the construction of a storm drainage importation canal seventy feet in width In addition to these improvements, the City may concurrently proceed with other City improvements in the general vicinity of the District Section 3 That the property to be assessed for the improvements shall be as follows Lot 1 , Landmark Subdivision P U D in the Citv of Fort Collins, Larimer County, Colorado Section 4 The estimated total construction cost of the District improvements including engineering costs , but ex- cluding the cost of planning, constructing or otherwise acquiring the improvements, legal and advertising costs interest during construction and until assessments are made by ordinance against the properties benefitted and other costs to the District, as shown by the estimate of probable total cost as made by the Director of Public Works , is $720, 000 00 The estimated amount or proportion of the total cost to be paid by other than special assessments is $470 , 800 00 The balance of the estimated total cost in the District, $249, 200 00, upon the completion of the improvements , shall be assessed against the propert} in the District owned by the Petitioner as follows 4 1 Street and Utility Improvements to Hobbit Street The Petitioner in the District has heretofore waived the provis _ons of Section 16-8 of the City Code (relating to the maximum cost of improvements) with regard to the street and utility improvements to Hobbit Street in the District and the total actual cost for said improvements shall be assessed against property owned by the Petitioner on a front footage basis and , further, said property shall be assessed the cost of improving that portion of Hobbit Street within the District not abutting said property, subject to reim- bursement therefor pursuant to Section 99-6B ( 6) , Section 112-43 and Section 112-74E ( 6) of the City Code 4 2 Street Improvements to Prospect and Shields Streets The cost of street improvements to Prospect and Shields Streets within the District shall be assessed against property in the District owned by the Petitioner, on a front footage basis 4 3 Street Improvements to the Intersection of Prospect and Shields Streets The cost of street improvements to the southeastern quarter of the intersection of Prospect and Shields Streets shall be assessed against property in the District owned by the Petitioner, on an area basis 4 4 Importation Canal Improvements The cost of storm drainage improvements on the property in the District owned by the Petitioner and consisting of a storm drainage importation canal seventy feet in width and running from the western boundary line of said property adjacent to Shields Street to the eastern boundary of said property, on an area basis Section 5 Said assessments shall be payable in not more than 15 equal annual installments with the interest on the unpaid installments to be the same as the interest rate pavable on bonds to which interest rate shall not exceed 18% per annum Section 6 That on the 4th day of October , 1983 , at the hour of 5 30 P M or as soon thereafter as the matter may come on for hearing, in the Council Chambers of the City Hall , City of Fort Collins, the Council of the City of Fort Collins will consider the ordering by Ordinance of the proposed improvements and hear all complaints and obDections that may be made and filed in writing concerning the proposed improvements by the owners or any interested persons Section 7 That the Petitioner in said District has waived all notice requirements pursuant to Chapter 16 of the Code of the City of Fort Collins Passed and adopted at a regular meeting of the Council of the City of Fort Collins this
