OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING AND OVERRULING THE DECISION
OF THE PLANNING AND ZONING BOARD
WHEREAS, on June 27 , 1983 , the Planning and Zonin Board of the
Council of the City of Fort Collins considered as a Co my referral , a
proposal submitted by Joseph C Roesser, Jr for the development of a
portion of the Pine Ridge Open Space Area presently o ned by the City of
Fort Collins, and
WHEREAS, after discussion and public hearing oncerning the same, the
Planning and Zoning Board recommended to the C unty of Larimer that the
said proposal be approved contingent upon dev opment upon said property
not extending above the "ridgeline" of the sa property, and
WHEREAS, the Planning and Zoning Boar further conditioned its appro-
val on the retention by the City of a f ty foot (50' ) landscape easement
along the westerly side of the establis d property line (ridgeline) of the
said property, and
WHEREAS, the Council of the C ty of Fort Collins has determined that
it is in the best interests of he citizens of the City that the said
ruling of the Planning and Zo ng Board be modified and overruled with
respect to the aforementioned ntingenn es
NOW, THEREFORE, BE IT ESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the decision of the Planning and Zoning Board making recom-
mendation to the County f Larimer be overruled, amended and modified to
provide that the develo ent to be constructed upon the aforesaid property
be constructed at an evation not to exceed the treeline (defined as that
elevation five feet ' ] below the average height of the five highest trees
along and immediat y adjacent to the ridgeline and within a distance of 20
feet on either si a of any proposed structure) and that the City maintains
a landscape eas ent of thirty feet (30' ) in width along the westerly side
of the establi ed property line
