HomeMy WebLinkAbout1983-015-01/04/1983-COMMITTING THOSE MONIES GENERATED BY AN ADDITIONAL 75 SALES AND USE TAX TO SPECIFIC PROJECTS (NO ACT 2 RESOLUTION 83-15 % OF THE COUNCIL OF THE CITY OF FORT COLLINS COMMITTING THOSE MONIES GENERATED BY AN ADDITIONAL / 75 SALES AND USE TAX TO SPECIFIC PROJECTS WHEREAS, on October 19, 1982, the Council of the City of Fort Collins adopted Ordinance No 113, 1982, imposing an additional ,15 hundredths percent ( 75%) Sales and Use Tax in the City of Fort Collins to be effective December 1, 1982, and WHEREAS, subsequent to the adoption of the aforementioned ordinance, qualified electors of the City of Fort Collins submftted petitions to the City Clerk calling for a referendum on the 75 hundredths percent ( 75%) Sales and Use Tax issue, and / WHEREAS, the additional seventy-five hundredths percent ( 75%) Sales and Use Tax represents a sound business approach in addressing the needs of the City to / 1) protect the investment of the rrent infrastructure, 2) provide for the capital eeds of our growing community, and 3) provide for the life safe/ty and convenience of the residents who now live in Fort Collis, and WHEREAS, without the addition of the seventy-five hundredths percent ( 75%) Sales and Use Tax, tpe deferred cost to address needed street repair and congestion will be significantly higher, and WHEREAS, the addition of the seventy-five hundredths percent ( 75%) Sales and Use Tax r"resents the final element of a soundly financed package that has bptn developed by this and previous City Councils to address all Curren and ongoing operations and capital needs of the City of Fort Collins WHEREAS, rsuant to Article XVII, Section 3, of the Charter of the City of Fort, ollins, the Council adopted Ordinance No 152, 1982, said ordinance r erring the 75 hundredths percent ( 75%) Sales and Use Tax issue to a ote of the people at the general City election to be held March 8, 1983, d W REAS, it is the opinion of the Council that said proposed referen- dum i an issue in which the Council has an official concern, and WHEREAS, Council wishes to take official action to set aside, for s cified projects, those monies to be generated by an additional 75 ales and use tax increase Taken 114/ B3 NOW, THEREFORE, BE IT RESOLVED as follows Section 1 That upon passage/initiation of an additional 75% Sales and Use Tax the City Council commits to expend the revenues of this tax for capital construction projects Section 2 That the City Council commit that the following capital construction projects will be the projects for which expenditures of the proceeds of this tax will be made, and only upon the completion of these projects will excess revenues, if any, be allocated to other projects Percent Street Rehabilitation $ 4 5 million 21% Street Program 10 0 million 47% Timberline-Prospect Intersection South Lemay-Horsetooth to Harmony Drake-Taft Hill Intersection Prospect Street-Shields to Taft including intersections Timberline Road-Prospect to Summitview ROW and Construction Shields-Mulberry Intersection Drake-UP RR Crossing Drake Road-C&S to Shields Reconstruction South College Medians (Horsetooth to Harmony) Horsetooth-UP RR Crossing Street Oversizing Lincoln-Mountain Intersection 0 & M for New Community Park Areas $ 1 6 million 7% Facilities $ 3 6 million 16% Block 31 Old City Hall South Side Service Center Indoor Pool Outdoor Pool-Bath House Parks & Rec Administration Lincoln Center Canyon West City Fire Protection (PFA) 2 0 million 9% Station in So East Increase Rescue Response in So East (Ladder, Truck & Battalion) Station in North Administrative Offices Rolling Stock Replacement Section 3 That this tax will expire at the end of 5 years or, in the alternative, be submitted anew to the voters with a new list of projects Section 4 That the City Council hereby finds and determines that this tax is necessary to insure a sound business approach to which the Council is committed, particularly a) the protection of investment in the infrastructure, b) providing the capital needs for the future, and c) providing for the life, safety and convenience of present resi- dents, and to avoid deferring needed street repair, maintenance, and new construction Section 5 City Council finds and determines that this tax is the final element in a sound-financing package developed by many City Councils over many years and, as such, City Council commits there will be no sales or property tax increases by the City for the next 5 years, unless author- ized by the voters Passed and adopted at a regular meeting held this 4th day of January, A D 1983 Mayor ATTEST City Clerk -3-
