HomeMy WebLinkAbout1983-016-01/04/1983-MAKING A FINDING THAT THE .75% SALES TAX REFERENDUM IS A MATTER OF OFFICIAL CONCERN AND AUTHORIZING RESOLUTION 83-16 OF THE COUNCIL OF THE CITY OF FORT COLLINS MAKING A FINDING THAT THE 75% SALES TAX REFERENDUM IS A MATTER OF OFFICIAL CONCERN AND AUTHORIZING THE DISSEMINATION OF GENERAL, OBJECTIVE INFORMATION TO THE PUBLIC AT LARGE RELATIVE TO THE SALES AND USE TAX ISSUE WHEREAS, on October 19, 1982, the Council of the City of Fort Collins adopted Ordinance No 113, 1982, imposing an additional seventy-five hundreths percent ( 75%) Sales and Use Tax in the City of Fort Collins to be effective December 1, 1982, and WHEREAS, subsequent to the adoption of the aforementioned ordinance, qualified electors of the City of Fort Collins submitted petitions to the City Clerk calling for a referendum on Ordinance No 113, 1982, concerning the 75% Sales and Use Tax issue, and WHEREAS, pursuant to Article XVII, Section 3 of the Charter of the City of Fort Collins, the Council adopted Ordinance No 152, 1982, said ordinance referring Ordinance No 113, 1982, to a vote of the people at the general City election to be held March 8, 1983, and WHEREAS, it is the considered opinion of the City Council that City staff should make available to the City at large, information of a general , objective nature relative to the 75% Sales and Use Tax issue, and WHEREAS, 1-45-116 , C R S 1973 ( Campaign Reform Act) allows the governing body of a political subdivision to make contributions or contri- butions-in-kind in campaigns involving issues of official concern, provided that specific approval of such contributions or contributions-in-kind first be given by the political subdivision NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows Section 1 That the Council hereby finds and determines that the proposed referendum on Ordinance No 113, 1982, concerning the 75% Sales and Use Tax is an issue of official concern to the Council Section 2 That the City Council hereby approves the use of staff and appropriate supplies as necessary for the purpose of disseminating general , objective information to the public at large relative to the 75% Sales and Use Tax issue Section 3 That the City Administration present to Council by January 18, a proposal for dissemination of information including monies to be expended, in-kind contributions to be provided, and resources to be utilized Passed and adopted at a regular meeting held this 4th day of January, A D 1983 Mayor ATTEST city clerk -2-
