OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE USAGE, BY PLATTE RIVER
POWER AUTHORITY, OF A PORTION OF THE
CAPACITY OF THE SOLDIER CANYON OUTLET
WHEREAS, in connection with the construction of the Rawhide Power
Plant, Platte River Power Authority has determined it necessary to nego-
tiate with the City of Fort Collins to acquire a portion of the capacity of
the Soldier Canyon Outlet to Horsetooth Reservoir, owned in part by the
City of Fort Collins, and
WHEREAS, the maximum capacity desired by Platte River Power Authority
of said Soldier Canyon Outlet is 3 c f s for which right Platte River
Power Authority is prepared to pay the sum of Thirty-Five Thousand Dollars
($35,000 00) together with the sum of One Thousand Five Hundred Dollars
($1,500 00) annually for operation and maintenance, and
_ WHEREAS, the Water Board of the City of Fort Collins has considered,
discussed and approved the proposed agreement as prepared and attached
hereto, and
WHEREAS, in the considered opinion of the Council of the City of Fort
Collins, said agreement is fair and equitable to all parties, and
WHEREAS, said agreement can be executed and said capacity conveyed to
Platte River Power Authority without jeopardy to the interests or activi-
ties of the City of Fort Collins
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Mayor and City Clerk be, and they hereby are, authorized
to and directed to execute said agreement in the form as attached hereto
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins held this 3rd day of Februa y, 1981
