COSTS AND ASSESSMENTS FOR STORM SFQER IMPROVEhENT DISTRICT #17,

DISTRICT, DETERMINING THE AHOUPT OP PPOPORTION OF THE TOTAL
COST TO BE PAID BY A METHOD OTHER ThAN ASSESSMENTS AGAINST
PPOPERTY IN THE DISTPiCT, THE NUmSER OF IhSTALLNENTS AND THE
TIDE WITHIN WHICH THE COST OF THE IMPPOVEMENTS ASSESSED AGAINST
ThE PP,OPEPTY IN THE DISTRICT WILL BE PAYABLE, THE PATE OF INTEREST
TO BE CHARGED ON UNPAID INSTAL VENTS, THE PROPERTY TO aE ASSESSED FOR
THE IMPROVEMENTS, THE METHOD UK MAKING SUCH ASSESS"ENTS, AND THE DATE
WHEN THE COUNCIL WILL HOLD A HEARING AivD CONSIDER THE
ORDEPING DY ORDINAi'CE OF THE PROPOSED IM PFO"EMENTS
WHEPEAS, heretofore, the City Council by resolution directed the City
Engineer to make a complete survey of the proposed Storm Seger Improvement
District #17, including the preparation of a map, plans and specifications,
ano estimate of cost of the improvements in said proposea district, and
WHEREAS, such survey of the proposed District was made and a report
thereon given to the City Council and the Council thereafter by Resolution
79-99 aaopted said report and set a date for a public hearing on the
formation of the District in accordance with saio report, and
WHEPEAS, after the uouncil hau adopted Resolution /9-99, owners of the
property included it the District e, ecuted an Agreement wherein saia owners
aareed to pay one hundred percent (100%) of the costs of said District,
provided that the total assessable cost against said owners did not exceed
Two Hundred Seventy-Four Thousand Four Hundred Eighty-Five Dollars
($274,435 00) plus a five percent (5h) contingency, and
WHEREAS, in the aoretment between said property owners, the owners
have waived all notice of the proposed formation of the District and
consented that such District may be formed without further notice to such
o�rners and that assessments may be made against each ovner's propert, to
pay the costs incurred in the District as set forth in said agreerent,
and
WHEREAS, said owners have causea a new engineering report to be mace
of propose& Storm Seger Irprovement District 117, including the preparation
of a map, plans and specitir_ations, and estimate of cost of the improve-
ments in said proposco District, and
WHEREAS, such report has been made to the City Council , including
the details and specifications for the proposed District, and
INEREAS, the City Council desires to repeal Resolution 79-99 and to
adopt a new resolution contained herein based upon the new engineering
report presented to the Council
NOW, ThEREFORE, BE IT RESOLVED BY THE COUNCIL OF ThE CITY OF FORT
COLLINS
Section 1 That the report, plans, specifications, map and estimate
as presentea by the City Engineer for said district be, and the same hereby
are, accepted and approved
Section 2 That the total cost of such improvements shall be paid by
assessments against the property in tine district and that the City at large
shall not pay any cost of such improvements
Section 3 That the property to be assessed for the improvements
shall be as follows All property within the oistrict boundaries except
streets and alleys, said district bauridaries being more particularly
described on Exhibit A, attached hereto, and by this reference made a part
hereof
Section 4 Thal: assessments for tiie cost of installing the improve-
ments in said district shall be made according to tiie following contribut-

Section 5 That said assessments shall be payable in ten (10) equal
annual installments, with interest on the unpaid installments at the rate
of ten percent (10;) per annum
Section 6 That the probable cost of said improvements as shown by
the total estimate of the Cit. Engineer is Three Hundred Tvelve Thousand
Four Hundred Fifty Dollars ($323,450 00) , exclusive of the cost of collec-
tion , legal , advertising, engineering , financing, interest and other
incidentals and that to said cost will be added an awOUnt not to exceed
Forty-Four Thousand Seven Hundred Sixty-Seven Dollars ($44,70 Ou) of such
cost to cover the expense of collection, legal and advertising, engineer-
inq , financing , interest during construction, and other incidentals
Section 7 That the muxlrflUm cost to be assessed, exclusive of the
cost of collection, legal and advertising, engineering, finarcing, interest
during construction, and other incidentals, is as follows S 08c, 69 per
square foot of contributing acreage and that on the 4th day of March, 198G,
or as soon thereafter as the matter ma} come on for hearirq in the Council
Chambers of the City Hall , Fort Collins, Colorado, is the gate that the
City Council will consider the ordering by Ordinance of the proposed
improvements and hear all complaints and objections that may be made and
filed in writing by the owners or any property to be assessed or persons
interested generally All co�pleints or objections should be made in
writing and filed in the Office of the City Clerk in the City hall before
said date
Section 8 That a map of the District and estimate of cost, schedules
showing the approximate amount to be assessed upon the several lots or
parcels of land within the District, and all the proceedings of the City
Council in the premises are on file and can be seen and examinea in the

Section 9 That on the 4th day of March, 1980, at the hour of
5 30 o 'clock N M , or as soon thereafter as the matter may come on for
hearing, in the Council Chambers of the City Hall , Citv of Fort Collins, is
the date on which the Council of the City of Fort Collins will consider the
ordering by ordinance of the proposed irripr ovements and hear all complaints
and objections that may De made and filed in writing concerning the pro-
posed improvements by the owners of any real estate to be assessed or any
persons interested generally
Section 10 That Resolution No 79-y9 be, and it hereby is, repealed
Passed and adopted at a regular meeting of the Council of the City
of Fort Collins held this 4th day of March A D 980
