( L - r RESOLUTION 82-1 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH THE POUDRE LANDMARKS FOUNDATION INC (FOUNDATION) FOR THE PURPOSE OF FACILITATING THE RENOVATION AND RESTOPATION OF THE AVERY HOUSE WHEREAS, the Avery House, owned by the City of Fort Collins, has been partially renovated and restored through the mutual efforts of the City and the Foundation, and WHEREAS, the City and the Foundation desire to continue the renovation and restoration of the Avery House and to conduct tours through the re- stored portions of said House, and WHEREAS , the City Council has determined that it is in the best interests of the City that an agreement between the City and the Foundation be executed for the purpose of accomplishing the continued renovation and restoration of the Avery House in order that the public, by touring the Avery House, may be made more aware of the historic development of the City, of said House, and of the significance of its contents NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the City Manager be, and he hereby is, authorized to enter into an agreement with the Poudre Landmarks Foundation, Inc for the purpose of continuation of the renovation and restoration of the Avery House, which agreement shall continue for an initial period of three years, commencing on January 1 , 1982, and terminating on December 31, 1985, and shall thereafter be automatically renewed from year to year for a total of seven years unless terminated by either party upon the giving of notice Said agreement shall provide for the phased renovation and restoration of the Avery House, without charge to the City, with the work to commence on the first floor of said House and provided that the City shall reserve the right to the use of the remainder of said House for City purposes until such time as the first floor has been completely renovated and restored, and provided further that the Foundation shall indemnify and hold harmless I the City from any claim arising out of the display, use and/or storage of personal property in any room of the Avery House by the Foundation Passed and adopted at a regular meeting of the City Council held this 5th day of January, A D 1982 4�j 4_a�k i May r � ATTEST City Clerk
