HomeMy WebLinkAbout1982-012-04/06/1982-AUTHORIZING THE ACQUISITION OF EMINENT DOMAIN PROCEEDINGS OF CERTAIN LANDS KNOWN AS THE HAHN PROPERT �v RESOLUTION 82-12 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE ACQUISITION OF EMINENT DOMAIN PROCEEDINGS OF CERTAIN LANDS KNOWN AS THE HAHN PROPERTY III THE CITY WHEREAS, the City desires to acquire a right-of-way over certain lands, known as the Hahn Property, hereinafter described for the purpose of establishing a bike/walkway, and WHEREAS, the City has attempted to negotiate the acquisition of a right-of-way with the owners of said lands, the negotiations have been unsuccessful , and, therefore, it appears that it will be necessary to acquire a right-of-way through proceedings in eminent domain NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 The Council finds and determines that it is necessary that the City of Fort Collins acquire a right-of-way over and across certain lands, known as the Hahn Property, more particularly described as follows A tract of land along the northerly side of Spring Creek situate in Tract 2, Replat of Springmeadows on Spring Creek, a subdivision in Section 24, Township 7 North, Range 69 West of the 6th Principal Meridian, City of Fort Collins, Larimer County, Colorado which is more particularly described as follows Considering the East line of the NE 1/4 of said Section 24 as bearing S 0°00' 21" E and with all bearings contained herein relative thereto and commencing at the NE corner of said Section 24 monumented by a found brass cap, thence along the East line of said NE 1/4 S 0000' 21" E 580 88 feet, thence S 82008' 39" W 50 47 feet, thence S 0000'21" E 40 50 feet to the True Point of Beginning of the tract to be described herein, thence S 0000'21" E 20 00 feet to the most easterly corner common to Tracts 1 and 2 , Replat of Spring- meadows on Spring Creek Subdivision, thence S 82°08'39" W 149 58 feet along the northerly line of said Tract 1 , thence S 9°05'21" W 6 79 feet along the westerly line of said Tract 1, thence S 87°13'19" W 3 30 feet to the beginning of a 70 00 foot radius tangent curve to the right having a chord of 59 41 feet which bears N 69030'53" W, and a central angle of 50013'09", thence along said curve 61 35 feet to the westerly line of said Tract 2, thence N 0000'39" E along the westerly line of said Tract 2 48 99 feet to the beginning of a 50 00 foot radius curve to the left having a chord of 73 51 feet which bears S 47018'26" E, and a central angle of 94038'05", thence along said curve 82 58 feet, thence N 79055'58" E 156 59 feet to the easterly line of said Tract 2 and the True Point of Beginning con- taining 0 0904 acres of land more or less to be used for construction of a bike/walkway for public use Section 2 The Council hereby finds and determines that it is not possible to acquire the right-of-way by negotiation with the owners of the land, and therefore, authorizes the City Attorney and the other proper officials of the City to acquire the right-of-way by eminent domain pro- ceedings Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this 6th day of April 1982 Mayor ATTEST City Cler�k -2-
