OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE ACQUISITION BY EMINENT
DOMAIN PROCEEDINGS OF CERTAIN LANDS KNOWN
AS THE GERIATRICS PROPERTY IN THE CITY
WHEREA the City desires to acquire a right-of-way over certain
lands, known as the Geriatrics Property, hereinafter described for the
purpose of est lishing a bike/walkway, and
WHEREAS, the City has attempted to negotiate the acquisition of a
right-of-way with a owners of said lands, the negotiations have been
unsuccessful , and, erefore, it appears that it will be necessary to
acquire a right-of-way through proceedings in eminent domain
NOW, THEREFORE, BE T RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS
Section 1 The Council nds and determines that it is necessary that
the City of Fort Collins acqui e a right-of-way over and across certain
lands, known as the Geriatrics roperty, more particularly described as
follows
A tract of land situate in act 1, Replat of Spring-
meadows on Spring Creek, a subdivision in Section 24,
Township 7 North, Range 69 Wess"k of the 6th Principal
Meridian, City of Fort Collins, "}rimer County, Colo-
rado, which considering the Ea& line of the NE
1/4 of said Section 24 as bearing S 0 0'21" E and with
all bearings contained herein relattXe thereto and
commencing at the NE corner of said Section 24 monu-
mented by a found brass cap, thence along t e East line
of said NE 1/4 S 0°00' 21" E 580 88 feet,\thence S
82008'39" W 50 47 feet, thence S 0°00'21 " E 88150 feet,
said point being the True Point of BeginningNf the
tract of land to be described herein, thence S 0°0'0'21"
E 92 00 feet along the easterly line of said Tract'�,1 ,
thence N 61014'07" W 102 96 feet, thence N 53°43'5511`
73 21 feet to the westerly line of said Tract 1 ,
thence S 89040'21" E 149 25 feet to the True Point of +
Beginning, containing 1690 acres more or less
to be used for construction of a bike/walkway for public use
Section 2 The Council hereby finds and determines that it is n�ot
possible to acquire the right-of-way by negotiation with the owners of\t
the land and, therefore, authorizes the City Attorney and the other proper
officials of the City to acquire the right-of-way by eminent domain pro-
ceedings
