HomeMy WebLinkAbout1980-149-11/18/1980-ADOPTING THE REPORT OF THE DIRECTOR OF PUBLIC WORKS ON THE ESTIMATES, COSTS, AND ASSESSMENTS FOR CON r � RESOLUTION 80-149 OF THE COUNCIL OF THE CITY OF FORT COLLINS ADOPTING THE REPORT OF THE DIRECTOR OF PUBLIC WORKS ON THE ESTIMATES, COSTS, AND ASSESSMENTS FOR CONSOLIDATED ALLEY-SIDEWALK IMPROVEMENT DISTRICT NO 11 , APPROVING THE DETAILS AND SPECIFICATIONS FOR SUCH PROPOSED DISTRICT, DETERMINING THE AMOUNT OR PROPORTION OF THE TOTAL COST TO BE PAID BY A METHOD OTHER THAN ASSESSMENTS AGAINST PROPERTY IN THE DISTRICT, THE NUMBER OF INSTALLMENTS AND THE TIME WITHIN WHICH THE COST OF THE IMPROVEMENTS ASSESSED AGAINST THE PROPERTY IN THE DISTRICT WILL BE PAYABLE, THE RATE OF INTEREST TO BE CHARGED ON UNPAID INSTALLMENTS, THE PROPERTY TO BE ASSESSED FOR THE IMPROVEMENTS, THE METHOD OF MAKING SUCH ASSESSMENTS, AND THE DATE WHEN THE COUNCIL WILL HOLD A HEARING AND CONSIDER THE ORDERING BY ORDINANCE OF THE PROPOSED IMPROVEMENTS WHEREAS, heretofore the City Council , by resolution, directed the Director of Public Works to prepare a map, plans, specifications and an estimate of the cost of the improvements proposed in Consolidated Alley- Sidewalk Improvement District No 11, and WHEREAS, the Director of Public Works has made his report and has presented the details and specifications for the proposed District NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows Section 1 That the report, plans, specifications, map and estimate as presented by the Director of Public Works and as they relate to the proposed alley improvement portion of Consolidated Alley-Sidewalk Improve- ment District No 11 be, and the same hereby are, accepted and approved. Section 2 That the property to be assessed for the proposed alley improvement portion of said District shall be those properties adjoining and abutting the existing alley Section 3 That no amount or proportion of the total cost of the alley improvement portion of said district shall be paid by any method other than assessments against property in said District Section 4 That assessments for the cost of installing the alley improvements portion of said District shall be assessed to the fifteen (15) property owners whose property adjoins and/or abuts the existing alley, at an assessment rate proportionate to each property' s total alley frontage Section 5 That the report, plans, specifications, map and estimate as presented by the Director of Public Works as they relate to the proposed sidewalk improvement portion of said District be, and they hereby are, accepted and approved Section 6 That the property to be assessed for the proposed sidewalk portion of said District shall be that property adjoining and abutting on the public right-of-way in which the sidewalk is installed Section 7 That no amount or proportion of the total cost of the sidewalk improvement portion of said District shall be paid by any method other than assessments against property in said District Section 8 That assessments for the cost of installing the sidewalk improvement district portion of said District shall be assessed to R M and Carol A Hansen, 1709 Morningside Drive, Fort Collins, Colorado, 80521, Parcel #97240-00-034 Section 9 That assessments for Consolidated Alley-Sidewalk Improve- ment District 11 shall be payable in ten (10) equal annual installments, with interest on the unpaid installments at a rate equal to the coupon rate on bonds issued for this purpose, not to exceed fifteen percent (15%) per annum Section 10 That on the 6th day of January, 1981 , at the hour of 5 30 P M , or as soon thereafter as the matter may come on for hearing in the Council Chambers of the City Hall , City of Fort Collins, the Council of the City of Fort Collins will consider the ordering by ordinance of the proposed improvements and hear all complaints and objections that may be made and filed in writing concerning the proposed improvements by the owners of any real estate to be assessed or any persons interested gen- erally Section 11 That the City Clerk be, and she hereby is, directed to give notice of publication and mailing to the owners of property to be assessed, and to all interested persons generally, all as set forth in Chapter 16 of the Code of the City of Fort Collins Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this 18th day of November 80 P1 ayor ATTEST _ as�_ _ City Clerk -2- NOTICE TO THE OWNERS OF PROPERTY TO BE ASSESSED IN CONSOLI- DATED ALLEY-SIDEWALK IMPROVEMENT DISTRICT NO 11 AND TO ALL INTERESTED PERSONS OF THE KINDS OF IMPROVEMENTS PROPOSED, THE NUMBER OF INSTALLMENTS, AND THE TIME IN WHICH THE COST OF SUCH IMPROVEMENTS WILL BE PAYABLE, THE RATE OF INTEREST TO BE PAID ON UNPAID AND DEFERRED INSTALLMENTS, THE EXTENT OF THE DISTRICT TO BE IMPROVED, THE PROBABLE COST AND THE MAXIMUM COST TO BE ASSESSED, THE TIME WHEN THE CITY COUNCIL WILL CONSIDER ORDERING BY ORDINANCE THE PROPOSED IMPROVEMENTS AND HEAR COM- PLAINTS AND OBJECTIONS, AND THAT A MAP OF THE DISTRICT AND DETAILS CONCERNING THE SAME ARE ON FILE AND CAN BE SEEN IN THE CITY CLERK'S OFFICE Public notice is hereby given to persons interested and to owners of property to be assessed in Consolidated Alley-Sidewalk Improvement District No 11 that the kind of improvements proposed for said district are the installation of a sidewalk and asphalt alley pavement, and that the cost of said improvements as assessed will be payable in ten (10) equal annual installments, with interest on the unpaid installments to be paid at a rate equal to the coupon rate on bonds issued for this purpose, not to exceed fifteen percent (15%) per annum, and that the extent of the district to be improved is as follows A Alley Phase - All property fronting the alley between Meldrum and Sherwood Streets from West Mountain to LaPorte Avenue B Sidewalk Phase - Completion of the sidewalk, a 75' gap, along the north side of Stuart Street from Stover Street to Spring Meadows Court, and the probable cost of said improvements as shown by the total estimate of the City Engineer, exclusive of the cost of collection, legal , advertis- ing, engineering, financing, interest, and other incidentals are A Alley Phase - $17,614 60 B Sidewalk Phase - $756 00, and that to said cost will be added an amount not to exceed twenty percent (20%) of such cost to cover the expense of engineering, legal fees, publi- cation, and administration Together with an amount not to exceed 7% for the cost of collection, and an amount not to exceed 15% per annum for interest accrued on bonds during construction and other incidentals incur- red in connection with said improvements and that assessments for the cost of such improvements within the district will be made as follows upon all of the lots and lands abutting on the alley and sidewalk improved in proportion as the frontage of each lot or tract of land is to the frontage l t of all lots and lands so improved, with each phase specifically itemized above to be considered a separate unit for purposes of assessment, and that the maximum cost to be assessed, inclusive of the cost of collection, legal and advertising, engineering, financing, interest during construction, and other incidentals, is as follows A Alley Phase - $25,012 73 B Sidewalk Phase - $1,073 52, and that on the 6th day of January, 1981, at the hour of 5 30 o'clock P M , or as soon thereafter as the matter may come on for hearing in the Council Chambers in the City Hall , Fort Collins, Colorado, is the date that the City Council will consider the ordering by ordinance of the proposed improvements and hear all complaints and objections that may be made and filed in writing by the owners of any property to be assessed or persons interested generally All complaints or objections should be made in writing and filed in the Office of the City Clerk in the City Hall before said date, and That a map of the district and estimates of cost, schedules showing the approximate amount per front foot to be assessed upon the several lots or parcels of land within the district and all proceedings of the City Council in the premises are on file and can be seen and examined in the City Clerk' s Office during business hours at any time before said hearing Dated at Fort Collins, Colorado, this 18th day of November, A D 1980 City Clerk -2-
