OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY MANAGER TO ENTER INTO AN
INTERGOVERNMENTAL AGREEMENT WITH THE COLOR-ADO
WATER/WASTEWATER AGENCY RESPONSE NETWORK("CoWARN")
WHEREAS,the Colorado Water/Wastewater Agency Response Network("CoWARN")is
a system formalized by the Colorado Department of Public Health and Environment,Water Quality
Control Division, so that utilities may assist other utilities in responding to emergencies; and
WHEREAS,CoWARN has developed a mutual aid agreement("CoWARN agreement')that
several other Colorado water and wastewater have entered into; and
WHEREAS, there is no cost associated with entering into the CoWARN agreement; and
WHEREAS,the City of Fort Collins,if it enters into the CoWARN agreement,may decide
on a case-by-case basis whether to aid another Colorado water or wastewater utility in an emergency
situation, whether to provide assistance in the form of personnel or equipment, or both, and may
elect to withdraw from the CoWARN agreement entirely with 60 days notice; and
WHEREAS, if the City enters into the CoWARN agreement and experiences a water or
wastewater emergency, the City may immediately seek assistance from other Colorado water and
wastewater utilities and the specialized resources they provide in responding to an emergency; and
WHEREAS,in order to be eligible for federal grants and reimbursements before,during and
after an emergency,the City must support the development of interstate mutual aid programs; and
WHEREAS, the CoWARN agreement contains an indemnification provision to protect
participating utilities and provides for reimbursement of costs as needed; and
WHEREAS,the City is authorized to enter into intergovernmental agreement to provide any
function,service or facility,such as mutual aid assistance in the event of an emergency,as provided
in Article II, Section 16 of the Charter of the City of Fort Collins and Section 29-1-203, C.R.S.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City Manager is hereby authorized to enter into the CoWARN agreement on the
terms and conditions described above and such other terms and conditions as the City Manager, in
consultation with the City Attorney, determines to be necessary and appropriate to protect the
interests of the City.
