OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING EXPENDITURES FROM THE ART IN PUBLIC PLACES
RESERVE ACCOUNT IN THE CULTURAL SERVICES AND FACILITIES FUND
TO COMMISSION AN ARTIST TO CREATE AN ART ELEMENT FOR THE
SPRING CANYON COMMUNITY PARK TREE PROJECT
WHEREAS, the City is currently working on construction of the new Spring Canyon
Community Park(the"Project"); and
WHEREAS, pursuant to Sections 23-303 and 23-304 of the City Code, one percent of the
funds appropriated for the Project was set aside in the Art in Public Places reserve account in the
Cultural Services and Facilities Fund for use in the acquisition or leasing of works of art, the
maintenance, repair or display of works of art, and administrative expenses related to the Art in
Public Places Program, in accordance with the Art in Public Places Guidelines adopted by Council
in Ordinance No. 047, 1998 (the"Guidelines"); and
WHEREAS, the Art in Public Places Board (the "Board"), selected an artist to design
artwork for the Project using an RFP process through the City's Purchasing Department; and
WHEREAS,Kenny Davis(the"Artist")was selected to work with the Project Team to create
a design concept appropriate to the Project site; and
WHEREAS, the Board evaluated the Artist's final design at its regular meeting on August
15, 2007, pursuant to the Guidelines; and
WHEREAS, based on that evaluation, the Board voted to recommend the Artist's proposal
for a sculptural piece created by the carving of three existing cottonwood trees at the Project site(the
"Art Project"); and
WHEREAS, the Art Project will convey one story concept, with one tree depicting a
mountain lion, a second featuring her kittens, and the third representing a sculptural carved tree
form; and
WHEREAS, the estimated cost to create the Art Project, including design, materials,
fabrication, installation and contingency for the Art Project, is $15,000; and
WHEREAS, those funds are available in the Art in Public Places reserve account in the
Cultural Services and Facilities Fund,and are appropriated as part of the 2007 budget,to provide for
the Artist's design fees, fabrication, travel, signage and contingency for the Art Project; and
WHEREAS, Section 23-308 of the City Code requires that the Board's selection of the
recommended art be presented for Council review and approval,because the cost of the art exceeds
$10,000.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Council hereby authorizes the expenditure of up to FIFTEEN THOUSAND
DOLLARS ($15,000) from the Art in Public Places reserve account in the Cultural Services and
Facilities Fund for the Art Project,which will consist of three sculptural pieces carved from existing
cottonwood trees at Spring Canyon Community Park, as proposed by the artist, Kenny Davis, and
the conceptual design of which was reviewed and approved by the Art in Public Places Board on
August 15, 2007.
Passed and adopted at a regular meeting of the Cq� of the City of Fort Collins this 4th
