OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO EXECUTE A QUIT CLAIM
DEED FOR TRACT "C" OF TRAILWEST, P U D , WHICH
HAD BEEN RESERVED AS AN ACCESS AND UTILITY
EASEMENT AND IS NO LONGER NEEDED
WHEREAS, Trailwest P U D , a replat of Trailwest Subdivision in the
City of Fort Collins, was approved on September 18, 1979 by the City
Council , and
WHEREAS, Tract "C" of said P U D was reserved for a future access and
utility easement to property to the south thereof, and
WHEREAS, the owners thereof have granted and conveyed to the City a
utility easement for the purpose of installation and maintenance of a water
line and sewer line therein, and
WHEREAS, the Council of the City of Fort Collins has determined that
any interest that the City may have with respect to an access easement
as a result of the aforementioned reservation is not used or intended to
be used for municipal purposes, nor secured for the purpose of being used
for municipal purposes, and that it is in the best interest of the City
of Fort Collins that the cloud on the title created as a result of said
reservation be cleared by the execution of a quit claim deed therefor
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the Mayor be and he here by is authorized to execute a quit
claim deed to Scavo-Dougherty Builders, Inc , quit claiming any interest
that the City may have in that portion of Tract "C" as reserved for the
purposes of general access, without quit claiming any interest that the
City has received by grant or conveyance for installation, maintenance and
access to water lines and sewer lines in said Tract "C", the sole purpose
of the execution of said quit claim deed to be to clear any cloud that may
exist upon the title as a result of the aforesaid reservation for general
access
Passed and adopted at a regular meeting of the City Council held this
7th day of June, A D 1983
