OF THE COUNCIL OF THE CITY OF FORT COLLINS
ADOPTING THE REPORT OF THE DIRECTOR OF PUBLIC WORKS
ON THE ESTIMATES, COSTS AND ASSESSMENTS FOR THE
LEIhAY/HARMONY SPECIAL IMPROVEMENT DISTRICT NO 78
APPROVING THE DETAILS AND SPECIFICATIONS FOR
SUCH PROPOSED DISTRICT, DETERMINING THE AMOUNT
OR PROPORTION OF THE TOTAL COST TO BE PAID BY
A METHOD OTHER THAN ASSESSMENTS AGAINST PROPERTY
IN THE DISTRICT, THE NUMBER OF INSTALLMENTS AND
THE TIME WITHIN WHICH THE COST OF THE IMPROVEMENTS
ASSESSED AGAINST PROPERTY IN THE DISTRICT WILL BE
PAYABLE, THE RATE OF INTEREST TO BE CHARGED ON
UNPAID INSTALLMENTS, THE PROPERTY TO BE ASSESSED
FOR THE IMPROVEMENTS, THE METHOD OF MAKING SUCH
ASSESSMENTS , AND THE DATF WHEN THE COUNCIL 17ILL HOLD
A HEARING AND CONSIDERING ORDERING BY ORDINANCE OF
THE PROPOSED IMPROVEMENTS
WHEREAS, heretofore, the Council by resolution directed the
Director of Public Works to make a complete survey of the proposed
Lemay/Harmony Special Improvement District No 78 , includina the
preparation of a map, plans and specifications and an estimate of
cost of the improvements in said proposed district, and
WHEPhAS, the Director of Public Works has made his report and
has presented the details and specifications for the proposed
district
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
FORT COLLINS
Section 1 That the report , plans , specifications, map and
estimates as presented by the Director of Public Works for said
district be, and the same hereby are, accepted and approved
Section 2 That the following estimates amount or proportion
of the total cost of such improvements shall be paid by the City
at large and not by assessments against property in the district,
to wit
Water main oversizing $97,500 00 , ( 20" waterline on Lemay
Avenue from Harmony Road to the southernmost property line of Lake
Sherwood Joint Venture property)
Water main oversizing $ 10,670 00 ( 16" waterline in Boardwalk
Drive)
Water main $3, 000 00 ( 14" line on Lemay Avenue ad3acent to
property owned by City)
Street construction and surfacing $4,000 00 (Lemay Avenue to
a width of 36 ' adjacent to property owned by City)
Section 3 That the property to be assessed for the
improvements shall be those properties owned by the petitioners as
set forth more particularly on Exhibit "A" attached hereto and by
this reference made a part hereof
Section 4 That the assessments for the cost of installing
the improvements in the district will be made as set forth on
Exhibit "B" attached hereto and by this reference made a part
hereof
Section 5 That said assessments shall be payable in
not less than ten ( 10 ) nor more than fifteen ( 15) annual
installments, with the interest rate on the unpaid installments to
be the same as the interest rate payable on bonds to be issued by
the district which interest rate shall not exceed eighteen per
cent ( 18% ) per annum
Section 6 That on the 21st day of June , 1983, at the hour
of 5 30 p m , or as soon thereafter as the matter may come on for
hearing in the Council Chambers of the City Hall , City of Fort
Collins, the Council of the City of Fort Collins will consider the
ordering by ordinance of the proposed improvements and hear all
complaints and objections that may be made and filed in writing
concerning the proposed improvements by the owners or of any
interested persons
Section 7 That the property owners included in said
district have waived all notice requirements required pursuant to
Chapter 16 of the Code of the City of Fort Collins
Passed and adopted at a regular meeting of the Council of the
City of Fort Collins thi t day of June, 1983
