OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE PURCHASE BY THE CITY OF
APPROXIMATELY SIXTY-SEVEN ACRES ADJACENT TO
THE SLUDGE MANAGEMENT FARM
WHEREAS, Harold F Baumgartner, owner of approximately sixty-seven
(66 67) acres of land located adjacent to and south of the City's sludge
management farm has agreed to convey said property to the City of Fort
Collins in consideration of the payment of the sum of One Hundred Thousand
Dollars (E100,000) by the City, and
WHEREAS, the Council of the City of Fort Collins finds and determines
that it is in the best interests of the City that said property, as more
particularly described on Exhibit "A" attached hereto, be purchased by the
City
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City Manager be, and he hereby is, authorized to negotiate
for the purchase of that certain parcel of land as described on Exhibit A
attached hereto, for and in consideration of the sum of One Hundred Thou-
sand Dollars (E100,000) to be paid to the owner thereof in cash or certi-
fied funds on or before August 15, 1983, said property to be conveyed by
merchantable title and free and clear of all liens, encumbrances and taxes,
and upon condition that the owner thereof provide for the City prior to
closing a commitment for title insurance in the sum of One Hundred Thousand
Dollars ($100,000) and, after closing, provide the title policy
Passed and adopted at a regular meeting of the City Council held this
5th day of July, A D 1983
