OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING THE ACCEPTANCE OF THE PROPOSED DONATION
OF THE SCULPTURE "TRANSCEND"
WHEREAS, in the summer of 2007, David Neenan and the Neenan F ily L.L.L.P.
("Neenans"),in cooperation with the Downtown Development Authority(DDA), mmissioned the
artist Collen Nyanhongo to create a sculpture, titled "Transcend" (the "Artw k"), in Old Town
Square; and
WHEREAS,the DDA and the City's Art in Public Places Prog (APP)wish to partner to
create another art attraction in the same location in Old Town Squa this summer; and
WHEREAS, the Neenans wish to donate the Artwork the City; and
WHEREAS, the value of the Artwork is estimate at over $10,000; and
WHEREAS, if the donation is accepted, the rtwork would be moved to a public location
on City property; and
WHEREAS,Section 23-309 of the C' Code requires that works of art with a value of$300
or more donated to the City to be placed i public area may be accepted only with approval of the
APP Board,and all such works with a v e of$10,000 or more maybe accepted only with approval
of the City Council, upon review of e proposed donation and the recommendation of the APP
Board; and
WHEREAS, at its re lar meeting on February 18, 2009, the APP Board evaluated the
proposed donation of the rtwork based on the City's Art in Public Places Guidelines and
recommended that the C' Council accept the donation.
NOW, THE FORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS,that th ity Council hereby accepts the proposed donation of the sculpture"Transcend",
created by artis ollen Nyanhongo.
Pas d and adopted at a regular meeting of the Council of the City of Fort Collins this 5th
day of A.D. 2009.
