OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY MANAGER TO ENTER INTO
A CONTRACT WITH BALLER LIVESTOCK COMPANY
CONCERNING THE PURCHASE OF WATER RIGHTS
WHEREAS, Baller Livestock Co (Baller) is the owner of certain water
storage rights in Jackson County, Colorado, which water rights Baller has
offered to sell to the City, and
WHEREAS, said water rights would be useful to the City in maximizing
the potential water production of the City' s Michigan Ditch/Joe Wright
Reservoir project, and
WHEREAS, Baller has warranted to the City that it is the owner of
these water rights which ownership is not encumbered by an obligation with
regard to operation, repair or maintenance of the reservoir containing said
waters, and
WHEREAS, the Council of the City of Fort Collins has determined that
it is in the best interests of the City that the City Manager execute a
contract with Baller for the purchase of 1,200 acre feet of water storage
rights in the Meadow Creek Reservoir in Jackson County, Colorado, provided
that Baller meet the various conditions as are set forth in the contract to
be executed for the total purchase price of eight hundred and twenty-nine
thousand four hundred dollars ($829,400 00)
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City Manager be, and he hereby is, authorized on behalf of
the City of Fort Collins, Colorado, to enter into an agreement with Baller
Livestock Company, a Colorado general partnership, for the purpose of
purchasing 1,200 acre feet of water storage rights in the Meadow Creek
Reservoir in Jackson County, Colorado, for the purchase price of $829,400
subject to the terms and various conditions as contained in said agreement
which conditions must be satisfied on or before August 1 , 1983, and
further subject to appropriation by the Council of the City of Fort Collins
of funds sufficient to perform the obligation of the City as contained
in said agreement, which appropriation, if made, shall be made by January
31, 1983
Passed and adopted at a regular meeting of the Council of the City of
Fort Collins, held this 9th day of November, 1982
