HomeMy WebLinkAbout1982-174-12/07/1982-SUPPORTING PROPOSED STATE LEGISLATION FOR CIVIL REMEDIES BY UTILITIES FOR DIVERSION OF UTILITY SERVI RESOLUTION 82- 174 OF THE COUNCIL OF THE CITY OF FORT COLLINS SUPPORTING PROPOSED STATE LEGISLATION FOR CIVIL REMEDIES BY UTILITIES FOR DIVERSION OF UTILITY SERVICES WHEREAS, The City of Fort Collins owns and operates a municipal utility for the provision of electric service, and WHEREAS, it is becoming more and more apparent that incidences of diversion of such utility services by means of bypassing, tampering and unauthorized metering, account for a substantial loss of such services without remuneration to the City, and WHEREAS, such losses result in increased costs to other ratepayers, and WHEREAS, the Colorado General Assembly will be considering proposed legislative changes to specifically provide for certain civil remedies, including treble damages in certain cases, in order to facilitate collec- tion of damages from persons responsible for such diversions, and WHEREAS, The City of Fort Collins desires to endorse efforts in pursuit of such legislative changes NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the City of Fort Collins hereby endorses the efforts in pursuit of legislative changes to provide certain civil remedies, including treble damages in certain cases, in order to facilitate collection of damages from persons responsible for losses of revenue to utilities through diversion of utility services by means of bypassing, tampering, and un- authorized metering Passed and adopted at a regular meeting of the City Council held this 7th daffy of December, A D 1982 Mayor ATTEST City Clerk
