HomeMy WebLinkAbout1984-135-09/04/1984-ACCEPTING THE PETITION OF PROPERTY OWNERS REGARDING THE INITIATION OF THE HEART SPECIAL IMPROVEMENT RESOLUTION 84- 135 OF THE COUNCIL OF THE CITY OF FORT COLLINS ACCEPTING THE PETITION OF PROPERTY OWNERS REGARDING THE INITIATION OF THE HEART SPECIAL IMPROVEMENT DISTRICT, STATING THE NEED FOR, THE NATURE OF, AND THE LOCATION OF THE IMPROVEMENTS TO BE MADE, DESCRIBING THE AREA TO BE ASSESSED FOR THE SAME, AND DIRECTING THE DIRECTOR OF PUBLIC WORKS TO PREPARE AND PRESENT TO THE CITY COUNCIL THE NECESSARY INFORMATION FOR THE FORMATION OF SAID DISTRICT. WHEREAS, the Council of the City of Fort Collins, Colorado (the "Council" ) , has received the Petition from property owners in the area (the "Petitioners" ) of the proposed Heart Special Improvement District (the "District" ) requesting that Council initiate pro- ceedings for the creation of a special improvement district for the purpose of acquiring, constructing, and installing street, water, sanitary sewer, storm drainage, and irrigation ditch improvements in the City of Fort Collins, Colorado ( the "City" ) ; and WHEREAS, the Council has received the Petition, accepts the same, and desires to proceed with the formation of the District. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1. That the Petition as submitted by Petitioners requesting the formation of the District is hereby received and accepted. Section 2. That the improvements to be constructed consist generally of street pavement, curb and gutter, sidewalk, grading, water lines, sanitary sewer lines, storm drainage, and irrigation ditch improvements. Such improvements are needed in order to provide adequate access for vehicles and pedestrians to the properties abutting the streets to be improved, and in order to provide adequate utility service to properties within the District. Section 3 . That it is recognized that the street, water, sewer, storm drainage, and irrigation ditch improvements as hereinafter designated, will confer special benefits on the real property in the District and general benefits to the City at large. Section 4 . That the nature and location of the improvements to be made in the District as follows: A. Streets Street improvements, including curb, gutter, side- walk, asphalt, base course, and grading, will be made for John F. Kennedy Parkway, extending South from its intersection with Board- walk Drive to the South boundary of the District, and for Troutman Parkway, commencing approximately 650 feet East of South College Avenue and extending easterly to Boardwalk Drive. B. Water The water distribution system will provide a 12-inch line between Boardwalk Drive and South College Avenue, and an 8-inch line in portions of John F. Kennedy Parkway and Troutman Parkway. C. Sanitary Sewer Sanitary sewer will be a system of 8-inch mains within the District flowing to the 21-inch Warren Trunk interceptor main south of the District boundary. D. Storm Drainage Storm drainage improvements will consist of an 18 and 24-inch reinforced concrete pipe storm sewer system, including catch basins and release structures, and improvements to the Larimer County Canal No. 2 Irrigation Ditch for storm drainage management. E. Irrigation Ditch The Larimer County Canal No. 2 Irrigation Ditch will be re-aligned and structurally improved along most of its reach within the District boundaries. In addition, a bridge structure will be constructed spanning the ditch at the intersection of John F. Kennedy Parkway and Troutman Parkway within the District. Section 5. That the Director of Public Works is directed to prepare and present to the Council the following: a. Preliminary plans and specifications of the improve- ments proposed. b. An estimate of the total cost of such improvements, including the cost of constructing the same, engineering, legal and advertising costs, interest during construction and until assess- ments are made by ordinance against the properties benefited, and other incidental costs. C. A map of the District to be assessed for the cost of improvements. Section 6. That the area to be assessed for the improvements described in Section 4 shall be as set forth in the Petition heretofore submitted by Petitioners. Section 7. That said improvement District shall be known as the Heart Special Improvement District No. 84.
