OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE EXECUTION OF AN EXCHANGE
OF REAL ESTATE AGREEMENT WITH CALVIN C.
AND LOIS M. JOHNSON FOR THE PURPOSE OF
CONSTRUCTION OF THE TIMBERLINE/PROSPECT
INTERSECTION PROJECT
WHEREAS, the City is engaged in the Timberline/Prospect Intersection
project for the purpose of bringing the said intersection up to arterial
street standards to accomodate traffic increases as presently experienced
at the intersection; and
WHEREAS, as a part of said project, it is necessary and desirable to
acquire a .9 acre parcel of land from Calvin C. and Lois M. Johnson;
and
WHEREAS, the City is the owner of a certain .9 acre parcel in the
vicinity of said intersection which parcel is not used nor intended to be
used for municipal uses, nor secured for the purpose of being used for
municipal purposes, and it is in the best interest of the City of Fort
Collins that the said parcel be exchanged to Calvin C. and Lois M. Johnson
for said .9 acre parcel owned by them; and
WHEREAS, it is further in the best interest of the City that, as a
part of said exchange, the City relocate the existing buildings on the
Johnson site to a site immediately to the south thereof in order that the
realignment of the channel of Spring Creek may be accomplished.
NOW, THEREFORE, be it resolved by the Council of the City of Fort
Collins that the City Manager be and hereby is authorized to enter into an
exchange of real estate agreement with Calvin C. and Lois M. Johnson for
— the exchange of said parcels of land in the vicinity of the Timberline/
Prospect intersection; that the relocation of existing buildings upon the
Johnson site be accomplished by the City as aforesaid; and that the Mayor
be, and he hereby is, authorized to execute such deeds of conveyance as may
be necessary to accomplish the foregoing.
Passed and adopted at a regular meeting of Council of the City of Fort
Collins this 7th day of August, A.D. 1984.
