HomeMy WebLinkAbout1984-104-07/03/1984-WAIVING THE OFF-SITE STREET IMPROVEMENTS REQUIREMENT FOR DEVELOPMENT IN THE URBAN GROWTH AREA(SPRING RESOLUTION 84- 104 OF THE COUNCIL OF THE CITY OF FORT COLLINS WAIVING THE OFF-SITE STREET IMPROVEMENTS REQUIREMENT FOR DEVELOPMENT IN THE URBAN GROWTH AREA (SPRINGFIELD RECREATIONAL CENTER, PUD WAIVER) WHEREAS, the Urban Growth Area Agreement provides that in order for sites to develop within the Urban Growth Area certain phasing criteria need to be met; and WHEREAS, the Larimer County Commissioners may waive phasing criteria for development in the Urban Growth Area, provided that: 1. Such requested waiver is approved by the governing body of the adjoining municipality after said body has substantiated the required findings. 2. The waiver will not result in unplanned expense or provision of public services, improvements or facilities. 3. The waiver is consistent with the intent and purpose of the County and adjoining municipality's comprehensive plans and policies. 4. The waiver application contains material indicating approval may be granted without substantial detriment to the intent and purposes of the supplementary regulations applying to the area. 5. The waiver application contains material indicating there are exceptional circumstances applying to the specific piece of property which do not apply generally to the remaining property in the Urban Growth Area. 6. The waiver application contains materials indicating approval would not impair the public health and safety by creating undesirable traffic conditions, undesirable sanitary conditions, or adverse environ- mental influences in the area. and; WHEREAS, the intent of the waiver process is to give priority to in-fill development; and WHEREAS, the developer of Springfield Recreational Center, PUD agrees to construct certain improvements on Taft Hill Road to minimize the impact of development upon the community. WHEREAS, the Springfield Recreational Center PUD waiver request meets the criteria set forth above for waivers. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Springfield Recreational Center PUD off-site street improvement waiver be, and the same hereby is, granted on condition that the developer of the Springfield Recreational Center PUD perform the following: 1. Install a traffic signal at the intersection of Taft Hill Road and Horsetooth Road. 2. Widen the intersection of Taft Hill Road and Horsetooth Road to allow for southbound left-turn movements and westbound left-turn movements. 3. Widen Taft Hill Road to allow for left-turns from Taft Hill Road into the site. 4. Widen the intersection of Taft Hill Road and County Road 38E to allow for northbound left-turns. 5. Pay the UGA waiver fee, offset by the cost of the above referenced improvements. In the event that the cost of said improvements exceeds the waiver fee, there shall be no refund to the Developer.
