RESOLUTION 84-88
OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING AN ADDENDUM TO THAT AGREEMENT BETWEEN
THE CITY AND COLORADO STATE UNIVERSITY FOR THE
FURNISHING OF WATER AND SEWER SERVICE
WHEREAS, in order to enhance and improve the City' s water utility
system, the City desires to locate a fifty-four inch (54' ) water main on
the West side of the City, which main will be located in part on property
owned by the State Board of Agriculture (Board) and occupied by Colorado
State University (CSU) ; and
WHEREAS, it is in the best interest of the City to acquire property
adjoining Water Treatment Plant No. 2, for future expansion, which property
is presently owned by the Board; and
WHEREAS, the present water system serving the foothills campus of
CSU, and owned by the Board, does not provide adequate fire protection to
that campus; and
WHEREAS, the Board wishes to acquire an additional three inch (3' )
water tap on the foothills campus of CSU; and
WHEREAS, the City desires to install , at some time in the future, a
twenty-four inch (24' ) water main on the foothills campus of CSU, which
main would provide significant benefit to the Board by improving the
adequacy of the present water system at said campus; and
WHEREAS, City and CSU staff members have negotiated an agreement
whereby the Board would convey to the City all easements and property
needed by the City in order to expand the present City water system as
aforesaid in exchange for the provision by the City of enhanced fire
protection through future installation of the twenty-four inch (24' ) water
main and through the addition of a three inch (3' ) tap (for a total of two
3' taps) on said 24' water main for the exclusive use of the Board; and
WHEREAS, the Council of the City of Fort Collins desires to approve an
addendum to that agreement dated June 26, 1974 between the Board and the
City for the purpose of water supply to CSU, which addendum accomplishes
the exchange of easements and land for taps and enhanced water supply
all as hereinbefore set forth.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City Manager be, and he hereby is, authorized to execute
an addendum to the water supply agreement dated June 26, 1974, between the
City of Fort Collins and the State Board of Agriculture, by which addendum
the Board will convey certain property and easements , without charge, to

the City , in exchange for the provision by the City of enhanced fire
protection from the City' s water mains and the provision of an additional
three inch (V ) water tap for the foothills campus of Colorado State
University, all as described above, and more particularly set forth in said
addendum; and does further authorize the execution by the City Manager of
such easement agreements as are necessary to accomplish the foregoing.
Passed and adopted at a regular meeting of the Council of the City
of Fort Collins held this 5th day of June, 1984.
