HomeMy WebLinkAbout2006-036-03/21/2006-AUTHORIZING THE CITY MANAGER TO CONSIDER ANNEXATIONS UNDER THE CITYS INTERGOVERNMENTAL AGREEMENT WIT RESOLUTION 2006-036 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY MANAGER TO CONSIDER ANNEXATIONS UNDER THE CITY'S INTERGOVERNMENTAL AGREEMENT WITH LARIMER COUNTY REGARDING COOPERATION ON MANAGING URBAN DEVELOPMENT WHEREAS, on November 21, 2000, the City entered into an intergovernmental agreement with Larimer County (the "County") regarding cooperation on managing urban development(the"IGA"); and WHEREAS, paragraph 8(A) of the IGA states that the City will consider the annexation of any parcel of land located within the growth management area which is eligible for voluntary annexation; and WHEREAS, paragraph 6(A) of the IGA states, in effect, that the County will not accept any development applications for property which has any contiguity with the City limits unless the property owner seeks annexation to the City, in which event the City needs to notify the County as to whether or not the City intends to annex the property; and WHEREAS, the City Council has determined that with regard to certain types of voluntary annexations, the City Manager should be authorized to decide whether or not the annexation should be presented to the City Council for additional consideration; and WHEREAS, the Council has determined that the City Manager may, under the criteria established pursuant to this Resolution, consider certain voluntary annexations and respond to the County on behalf of the City that the City does not desire to annex those parcels proposed for annexation; and WHEREAS, the Council has further determined that the City Manager must be given criteria to guide his decision making with regard to such annexation proposals. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That, pursuant to paragraph 8(A) of the IGA , the City Manager is hereby authorized to consider the annexation of parcels of land located within the growth management area which are eligible for voluntary annexation, and to take either of the following actions: a. The City Manager may communicate to Larimer County that the City does not desire to annex the area if the annexation would: i. be difficult or costly to serve with a full range of urban services; or ii. consist of a single lot in an existing subdivision; or iii. consist of a part of an enclave or an area that the City anticipates will soon become an enclave. b. If a proposed annexation does not come within any of the above criteria, the City Manager shall refer the same to the City Council for additional consideration and recommendation to the County. Section 2. That the provisions of this Resolution do not apply to involuntary (enclave) annexations except those portions of an enclave that have contiguity to the City limits.
