OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY MANAGER TO CONSENT TO AN
ASSIGNMENT OF THE RIGHT OF FIRST REFUSAL AGREEMENT
WITH GIACO ENTERPRISES RELATING TO THE LEASING OF
THE "CAR BARN'
WHEREAS , the City of Fort Collins entered into a Right of First
Refusal Agreement with Giaco Enterprises on April 3, 1984 granting unto
Giaco Enterprises , a Colorado General Partnership, the right of first
refusal as against any acceptable lease that might be presented to the City
of Fort Collins for the purpose of leasing that property known as the "Car
Barn" ; and
WHEREAS, Eileen R. Humphreys, a general partner of Giaco Enterprises ,
is leaving the partnership, and, as a result, Giaco Enterprises desires to
assign all of its interest in the Right of First Refusal Agreement to
Anthony Giacopelli ; and
WHEREAS, the Right of First Refusal Agreement provides that Giaco
Enterprises may assign its interest in the right of first refusal only with
prior written consent of the City, which consent shall not be unreasonably
withheld.
NOW, THEREFORE, be it resolved by the Council of the City of Fort
Collins that the City Manager be, and he hereby is, authorized to consent
to an assignment of the Right of First Refusal Agreement with Giaco Enter-
prises to Anthony Giacopelli .
Passed and adopted at a regular meeting of the City Council held
this 20th day of November, A. D. 1984.
