HomeMy WebLinkAbout1984-168-11/20/1984-AUTHORIZING THE MAYOR TO RENEW AN AGREEMENT BETWEEN THE CITY AND THE UNION PACIFIC RAILROAD ALLOWING RESOLUTION 84-168 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE MAYOR TO RENEW AN AGREEMENT BETWEEN THE CITY AND THE UNION PACIFIC RAILROAD ALLOWING FOR THE CONTINUED OPERATION AND MAINTENANCE OF A 24-INCH SANITARY SEWER IN THE RAILROAD RIGHT-OF-WAY WHEREAS, on October 1, 1959, the City of Fort Collins ("City") entered into an Agreement with the Union Pacific Railroad Company ( "Railroad") for the right to operate and maintain a twenty-four inch (24") sanitary sewer in the Railroad right-of-way paralleling Riverside Avenue between Mulberry Street and Lemay Avenue; and WHEREAS, the City desires to continue operating and maintaining this sanitary sewer; and WHEREAS, it is necessary to renew the Agreement with the Railroad to allow the continued use of the Railroad right-of-way; and WHEREAS, the extension of the Agreement requires an initial payment of One Hundred Dollars ($100.00) with subsequent payments of One Hundred Dollars ($100.00) per year for each year of the ten ( 10) year term; and WHEREAS, provision is made for the Agreement to be reevaluated at the end of the ten year term. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Mayor be, and he hereby is, authorized to renew an Agree- ment with the Union Pacific Railroad Company for a term of ten (10) years at One Hundred Dollars ($100.00) per year for the operation and maintenance of a twenty-four inch (24" ) sanitary sewer on, along and across the right-of-way and under the track located parallel to Riverside Avenue between Mulberry Street and Lemay Avenue. Passed and adopted at a regular meeting of the City Council held this 20th day of November, 1984. 4.4 ATTEST: mayor 67 City Clerk
