OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE ACQUISITION BY EMINENT DOMAIN
PROCEEDINGS OF CERTAIN LANDS IN THE CITY
WHEREAS, the City of Fort Collins desires to acquire property needed
for the Westside Transmission Main Project; and
WHEREAS, the City has attempted to negotiate the acquisition of such
property but has been unsuccessful in such negotiations to the extent that
it has been unable to acquire property referred to as the Holmes property,
more particularly to be described as follows, and it appears it will be
necessary to acquire such property through proceedings in eminent domain.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS:
Section 1. That the City Council hereby finds and determines that it
is necessary that the City of Fort Collins acquire the Holmes property
located in the City of Fort Collins, more particularly described as follows:
A tract of land situate in the E1/2 of Section 8, Township
7 North , Range 69 West of the 6th P .M. , which considering
the East line of the SE1/4 of said Section 8 as bearing due North
and with all bearings contained herein relative thereto is
contained within the boundary lines which begin at the East
quarter corner of said Section 8 and run thence S87°54' 30"W
1342.19 feet along the centerline of LaPorte Avenue ; thence
SOO' 21'W 998.46 feet along an existing fenceline; thence N87°
57' E 1348.24 feet along an existing fenceline to a point on the
East line of the SE1/4 of said Section 8; thence N 999.20 feet
along said East line to the POINT OF BEGINNING.
to be used for the Westside Transmission Main Project.
Section 2. That the City Council hereby finds and determines that it
is not possible to acquire said parcel by negotiation with the owners of
the land and, therefore, authorizes the City Attorney and other proper
officials of the City to acquire said above-described property for the City
through eminent domain proceedings.
Passed and adopted at a regular meeting of the City Council held this
16th day of October, A.D. 1984.
