OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY TO ENGAGE IN
LITIGATION TOGETHER WITH THE STATE OF COLORADO
AGAINST THE UNITED STATES AIR FORCE
WHEREAS, the United States Air Force has conducted hearings to deter-
in the impacts on certain areas of the United States to analyze the
deter-

effect of the possible placement of a nuclear missile system known as
the MX missile in the states of Wyoming and Nebraska; and
WHEREAS, hearings were not conducted in the State of Colorado to
evaluate the impact of the MX system upon the State of Colorado, Larimer
County or the City of Fort Collins; and
WHEREAS, the City of Fort Collins requested that such hearings be
conducted in the City of Fort Collins by the United States Air Force and
such request was denied; and
WHEREAS, it is concluded that the City of Fort Collins could be
affected by the deployment of the MX missile system in the State of
Wyoming, as proposed; and
WHEREAS, the City of Fort Collins has been informed by the Governer of
the State of Colorado of proposed litigation to be initiated by the State
of Colorado to seek a preliminary injunction against the United States Air
Force to prevent an irretrievable commitment of resources for the develop-
ment and deployment of MX missiles until a _Supplemental Environmental
Impact Statement has been completed.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City Attorney is directed to join with the State of Colo-
rado, other counties and cities in the State of Colorado against the Presi-
dent of the United States, Department of Defense, Secretary of Defense,
Department of the Air Force, and Secretary of the Air Force, to seek on
behalf of the City of Fort Collins a preliminary injunction to prevent an
irretrievable commitment of resources for the development and deployment of
MX missiles until a Supplemental Environmental Impact Statement has been
completed and also to seek such other relief as the Court deems just and
proper.
Passed and adopted at a regular meeting of the City Council held this
