HomeMy WebLinkAbout1984-044-03/20/1984-ACCEPTING PETITIONS OF PROPERTY OWNERS REGARDING THE INITITATION OF A SPECIAL IMPROVEMENT DISTRICT, RESOLUTION 84- 44 OF THE COUNCIL OF THE CITY OF FORT COLLINS ACCEPTING PETITIONS OF PROPERTY OWNERS REGARDING THE INITITATION OF A SPECIAL IMPROVEMENT DISTRICT, STATING THE NEED FOR, THE NATURE OF, AND THE LOCATION OF THE IMPROVEMENTS TO BE MADE, DESCRIBING THE AREA TO BE ASSESSED FOR THE SAME , AND DIRECTING THE DIRECTOR OF PUBLIC WORKS TO PREPARE AND PRESENT TO THE CITY COUNCIL THE NECESSARY INFORMATION FOR THE FORMATION OF SAID DISTRICT. WHEREAS , the Council of the City of Fort Collins, Colorado ( the "Council" ) , has received Petitions from property owners in the area (the "Petitioners" ) of the proposed Provincetown/Portner Fstates South Special Improvement District (the "District" ) requesting that Council initiate proceedings for the creation of a special improvement district for the purpose of accuirinq, con- structing, and installing street , water , sewer , and storm drainage improvements in the Citv of Fort Collins , Colorado (the "City" ) ; and WHEREAS , the Council has received the Petitions , accepts the same , and desires to proceed with the formation of the district. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS: Section 1 . That the Petitions as submitted by Petitioners requesting_ the formation of the District are hereby received and accepted. Section 2. That the improvements to be constructed consist qenerally of street pavement , curb and gutter, sidewalks , street lighting, water lines, sanitary sewer lines , and storm drainage improvements . Such improvements are needed in order to provide adequate access for vehicles and pedestrians to the properties abutting the streets to be improved , and in order to provide adequate utility service to properties within the District. Section 3. That the locations of the improvements to be made in the District are as follows: A. Provincetown Improvements ( 1 ) The South half of Trilby Road from the west property line of Provincetown P.U.D. to Lemay Avenue to City standards for arterial streets ( 35 ' from center line to flow line) , including storm drainage improvements , sanitary sewer improvements, and water main improvements . ( 2) Brittany Drive from Trilby Road to Province Road to City standards for collector streets, including storm drainage improvements, sanitary sewer improvements , and water main improvements. ( 3) Province Road from Lemay Avenue to Bristol Drive to City standards for collector streets , including storm drainage improvements , sanitary sewer improvements , and water main improvements . (4 ) Bristol Drive from Province Road to Windsor Road (County Road 32) to City standards for collector streets , including storm drainage improvements , sanitary sewer improve- ments , and water main improvements . ( 5) Granville Drive from Lemay Avenue to Dinard Drive to City standards for local streets , including storm drainage improvements , sanitary sewer improvements , and water main improvements. (6 ) Brittany Ridge P.U.D. , a phase of the Provincetown Master Plan , to include roadway improvements to City standards for local streets, storm drainage improvements , sanitary sewer improvements , and water main improvements. B . Portner Estates South Improvements ( 1 ) The North half of Trilby Road from the end of existing improvements adjacent to the Southside Service Center to Lemay Avenue to City standards for arterial streets ( 35 ' from center line to flow line) , including storm drainage improvements and water main improvements . ( 2) Brittany Drive from Trilby Road to Lemay Avenue to City standards for collector streets , storm drainage improvements , sanitary sewer improvements , and water main improve- ments . ( 3) Compton Road from Brittany Drive to Westbourn Terrace to City standards for local streets , including storm drainage improvements, sanitary sewer improvements , and water main improvements . -2- • ( 4) Westbourn Terrace from Compton Road to Prospect Street to City standards for local streets , including storm drainage improvements, sanitary sewer improvements , and water main improvements. ( 5) Prescot Street from Westbourn Terrace to Compton Road to City standards for local streets, including storm drainage improvements, sanitary sewer improvements , and water main improvements. Section 4. That the Director of Public Works is hereby directed to prepare and present to the Council the following: a. Preliminary plans and specifications of the improvements proposed. b. An estimate of the total cost of such improvements , including the cost of constructing the same, engineering, legal and advertising costs, interest during construction and until assessments are made by ordinance against the properties bene- fited, and other incidental costs. C . A map of the District to be assessed for the cost of improvements . Section 5. That the area to be assessed for the improvements described in Section 3 shall be as set forth in the Petitions heretofore submitted by Petitioners . Section 6. That said improvement district shall be known as the Provincetown/Portner Estates South Special Improvement District No. 81 Passed and adopted at a regular meeting of the City Council held this 20th day of March ,, 1984. aArk&.
