OF THE COUNCIL OF THE CITY OF FORT COLLINS
BEING A RESOLUTION PROPOSING A TWENTY-FIVE
HUNDREDTHS PERCENT ( .25%) INCREASE ?N SALES AND
USE TAX ON ALL ITEMS EXCEPT FOOD FOR A PERIOD OF FIVE (5)
YEARS FOR THE PURPOSE OF OBTAINING FUNDS FOR THE
CONSTRUCTION OF A SWIMMING POOL/ICE RINK FACILITY
WHEREAS, under Section 8, Article XVII of the Charter of the City of
Fort Collins, the Council of the City of Fort Collins has the power to
refer a proposed ordinance to a vote of the people at a special election
called therefor; and
WHEREAS, the City Council has received a proposed Ordinance from
interested citizens which would increase the sales and use tax on all items
except food by an amount of twenty-five hundredths percent ( .25%) for the
purpose of providing funds for the construction of a swimming pool/ice rink
facility; and
WHEREAS, in the considered opinion of the City Council said proposed
ordinance should be herewith referred to a vote of the people at a special
election on May 1 , 1984.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS:
Section 1 . That there is hereby submitted to the qualified voters of
the City of Fort Collins at a special election on May 1 , 1984, the question
of whether or not the following proposed ordinance should be adopted:

REQUIRING THE CONSTRUCTION OF A SWIMMING POOL/ICE RINK
FACILITY FUNDED BY A TWENTY-FIVE HUNDREDTHS PERCENT ( .25%)
SALES AND USE TAX FOR FIVE YEARS ON ALL ITEMS EXCEPT FOOD
WHEREAS, the Council of the City of Fort Collins has enacted ordi-
nances for the obtainment and collection of sales and use taxes as set out
in Chapter 104 of the Code of the City of Fort Collins; and
WHEREAS, the citizens of Fort Collins desire to improve their quality
of life by expanding public recreational facilities to include a swimming
pool/ice rink facility; and
WHEREAS, the citizens of Fort Collins are resolved to accept a twenty-
five hundredths percent ( .25%) increase in the City' s sales and use tax on
all items except food for a five year period for the sole purpose of
funding this recreational facility; and
WHEREAS, the citizens of Fort Collins have voted for the enactment of
this ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS, as follows:
Section 1. The City of Fort Collins shall commit itself to the
construction, maintenance, and operation of an all-purpose recreation
facility to include an olympic swimming pool , a diving area, and a regu-
lation size, all-purpose ice rink.
Section 2. This recreation facility shall be constructed substan-
tially similar to that as originally designed for the City of Fort Collins
in 1979 by Hastings and Chivetta, Architects and Planners. Construction of
the facility shall be scheduled so as to be completed by December 31, 1986
and so as to avoid any potential increases in cost due to delay. In order
to meet the project completion date of December 31, 1986, Sales and Use Tax
Revenue Bonds are authorized to be issued and interest and issuance costs
are includable as a project expenditure.
Section 3. A City sales and use tax increase of twenty-five hun-
dredths percent ( .25%) for five (5) years on all sales and uses except
sales of food items shall be effective on January 1, 1985 to continue until
December 31, 1989, at which time such tax shall cease. Such increase in
sales and use taxes shall be in addition to all other sales and use taxes
collected pursuant to Chapter 104 of the Code of the City of Fort Collins.
Section 4. The revenue raised which is attributable to the portion
of the twenty-five hundredths percent ( .25%) tax to the total sales and use
taxes as defined in Chapter 104 of the Code of the City of Fort Collins,
excluding food items as currently defined by C.R.S. , §39-26-102(4.5) ,
shall be used exclusively to fund this recreational facility in the
following manner: First, this revenue shall be used to construct a facil-
ity reasonably similar to that previously described depending upon the
revenue actually and expected to be received. Second, revenue remain-
ing shall be retained to be used solely for the purpose of supporting
the facility's operational and maintenance costs until it might become
self-sufficient. Finally, any revenue remaining shall be applied to the
City' s General Fund.
Section 5. The City shall contribute without charge to this facil-
ity' s accounts, the use of land as a site for this facility. The City' s
contribution for support and coordination by City staff throughout the
construction phase, and management and staffing by City staff through the
construction of this facility shall be accomplished in accordance with the
City' s Capital Project Management Control System.
Section 6. The user fees for this facility shall be structured to
make all uses of this facility available to the citizens of Fort Collins."

of Fort Collins at a Special Election to be held in the several precincts
of the City on Tuesday, May 1, 1984, in substantially the following form:

MAINTAIN AN ALL-PURPOSE RECREATIONAL FACILITY
CONSISTING OF AN OLYMPIC SWIMMING POOL, DIVING AREA,
AND A REGULATION SIZED, ALL-PURPOSE ICE RINK BY
BY DECEMBER 31, 1986. THIS FACILITY SHALL BE
FUNDED BY A TWENTY-FIVE HUNDREDTHS PERCENT ( .25%)
INCREASE IN SALES AND USE TAX ON ALL ITEMS
EXCEPT FOOD FOR FIVE (5) YEARS TO BEGIN ON
JANUARY 1, 1985 AND CONTINUE UNTIL DECEMBER 31, 1989
AT WHICH TIME THE TAX SHALL CEASE
