OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE EXTENSION OF THE SUBLEASE AGREEMENT
WITH THE FORT COLLINS CONVENTION AND VISITORS BUREAU
FOR A PORTION OF THE FACILITY AT THE WELCOME CENTER,
LOCATED AT 3545 EAST PROSPECT ROAD, FORT COLLINS, COLORADO
WHEREAS, the City and the Colorado State Board of Agriculture (acting by and through
Colorado State University) (the "State") entered into an Intergovernmental Agreement ("IGA")
dated August 19, 1999, regarding the Environmental Learning CenterNisitors Center/Welcome
Center("Facility"), located at 3545 East Prospect Road in Fort Collins; and
WHEREAS, pursuant to the IGA, the City currently leases from the State and subleases
to Fort Collins Convention and Visitors Bureau a portion of the Facility; and
WHEREAS, the City's sublease with the Fort Collins Convention and Visitors Bureau
expires December 31, 2005; and
WHEREAS, the City Purchasing Department anticipates bidding out convention services
in the early part of 2006; and
WHEREAS, until there is a successful bidder, the City desires to extend the current
sublease through March 31, 2006; and
WHEREAS, under Section 23-114 of the Code of the City of Fort Collins, the Council is
authorized to lease any and all interests in real property owned in the name of the City, provided
that Council first finds that the lease is in the best interests of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
FORT COLLINS as follows:
Section 1. That the Council hereby finds that subleasing a portion of the Facility at
3545 East Prospect Road under the terms listed above is in the best interests of the City of Fort
Collins.
Section 2. That the City Manager is hereby authorized to execute a first amendment
to the sublease agreement consistent with the terms of this Resolution and containing such
additional terms and conditions as the City Manager, in consultation with the City Attorney,
determines appropriate and necessary to protect the interests of the City.
Passed and adopted at a regular meeting of th5,Atiq Council held this 20th day of
