RESOLUTION 86-188
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY MANAGER TO AMEND AN
ENGINEERING SERVICES CONTRACT WITH RBD, INC. ,
FOR THE DESIGN AND CONSTRUCTION INSPECTION
OF A DROP STRUCTURE ON THE POUDRE RIVER
TO REPAIR THE EXISTING DAM ADJACENT TO THE POWER PLANT
WHEREAS, the City of Fort Collins has maintained a concrete diversion
dam on the Cache La Poudre River near College Avenue for the purpose of
diverting cooling water to the nearby power plant; and
WHEREAS, the power plant was decommissioned in 1973 and the dam has
not been actively maintained since that time; and
WHEREAS, the natural flow of the river has caused erosion to the dam
and may jeopardize the land now being protected by retaining walls on
either side of the river and the College Avenue bridge; and
WHEREAS, the Light and Power Utility determined that a consulting
engineer should be contracted to investigate alternate methods and costs to
abandon, repair or replace the dam;
WHEREAS, RBD, Inc. was the consulting firm selected through the City's
proposal and qualification process as the firm best qualified to undertake
the study; and
WHEREAS, RBD, Inc. has completed its analysis, reviewed the options,
recommended that action be taken due to the eminent failure of the existing
dam, and has completed its duties under the agreement with the City; and
WHEREAS, the City staff has reviewed the analysis by RBD, Inc. , the
options, and the conditions of the river area involved; and
WHEREAS, the City staff has determined that a drop structure would
provide the best solution to the replacement of the dam and that it is
necessary to proceed in a timely fashion with the design and construction
of such a drop structure, subject to approval by the U.S. Corps of
Engineers, to avoid adverse consequences to the river and its environs; and
WHEREAS, RBD, Inc. has discharged its responsibilities in the analysis
in a timely and complete manner, and RBD, Inc. is familiar with the
conditions and requirements for the design of a drop structure; and
WHEREAS, pursuant to the agreement between RBD, Inc. and the City, a
fee has been negotiated with for the design and construction inspection of
a drop structure, such fee not to exceed $22,000 for design and $20,000 for
construction inspection.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City Manager be, and he hereby is, authorized to amend the
engineering services contract with RBD, Inc. for the analysis of the dam
across the Cache La Poudre River near the College Avenue Bridge to include

the design and construction inspection of a drop structure to repair the
dam; and upon the condition that the cost thereof shall not exceed
Twenty-Two Thousand Dollars ($22,000. ) for the design and shall not exceed
Twenty Thousand Dollars ($20,000. ) for the construction inspection.
Passed and adopted at an adjourned meeting of the Council of the City
of Fort Collins held this 25th day of November, A.D. 1986.
