OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE PURCHASE OF APPROXIMATELY SEVEN ACRES OF LAND
FOR STORM DRAINAGE AND PUBLIC NATURAL AREA PURPOSES
WHEREAS, First Interstate Bank is the owner of approximately 7 acres of
land located in north Fort Collins, west of Willox Lane and east of Redwood
Street, more particularly described on Exhibit "A," attached hereto and
incorporated herein by this reference and referred to herein as "the Property";
and
WHEREAS, the City has determined that the reasonable market value of the
Property is $30,400; and
WHEREAS, First Interstate Bank has agreed to sell the Property to the City
for the amount of $30,400; and
WHEREAS, the City intends to use the Property for storm drainage and public
natural area purposes; and
WHEREAS, the Council of the City of Fort Collins has adopted the
Evergreen/Greenbriar Master Drainage Basin Plan, which plan stipulates the need
for a regional detention pond on the Property; and
WHEREAS, one of the objectives of the City's Natural Areas Policy Plan, as
adopted by the City Council , is to establish a system of publicly-owned natural
areas to protect the integrity of critical conservation sites; preserve
outstanding examples of Fort Collins' diverse natural heritage; and provide a
broad range of opportunities for educational , interpretive and recreational
programs to meet community needs; and
WHEREAS, the purchase of the Property will help the City meet the
ob.jectives of the City's Evergreen/Greenbriar Master Drainage Basin Plan and
Natural Areas Policy Plan; and
WHEREAS, in the November 1992 General Election, the citizens of the City
of Fort Collins approved a 1/4 cent sales and use tax for the purpose of
acquisition and maintenance of natural areas; and
WHEREAS, $10,000 of the purchase price for the Property will come from the
Natural Areas Project ifi the Capital Projects Fund, and $10,40O of the- purchase-
price will come from the Evergreen/Greenbriar Basin Project in the Storm Drainage
Fund, which amounts represent the portions of the Property which will be used for
natural areas and storm drainage purposes, respectively; and
WHEREAS, the City Council has heretofore appropriated funds in the Natural
Areas Project in the Capital Projects Fund for the purpose of acquisition and
maintenance of natural areas, and there are sufficient amounts in this fund to
pay for the Natural Area's share of the cost of the Property; and
WHEREAS, the City Council has heretofore appropriated funds in the Storm
Drainage Fund for the purposes of acquiring land and constructing the Greenbriar
Regional Detention Pond, and there are sufficient amounts in this fund to pay for
the Stormwater share of the cost of the Property; and
WHEREAS, the City Council has determined that the purchase price of the
Property is fair and reasonable, and the purchase of the Property is in the best
interests of the citizens of the City of Fort Collins; and
WHEREAS, the Natural Resources Advisory Board, the Storm Drainage Board,
and the Parks and Recreation Board, have recommended the acquisition of the
Property on the terms and conditions stated above.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
as follows:
Section 1. That the City Manager and Mayor be, and hereby are, authorized
to execute such documents as are necessary for the City to acquire the Property
comprising approximately seven (7) acres of land, as described on Exhibit "A,"
for the amount of Thirty Thousand Four Hundred Dollars ($30,400) .
Section 2. That approximately two (2) acres of the Property shall be used
by the City for public natural areas, and approximately five (5) acres of the
Property shall be used for storm drainage purposes.

County of Latimer, State of Colorado,being described as follows:
Considering the north line of the Northwest 1/4 as bearing N 89056'14" W and with all
bearings contained herein relative thereto:
From the North 1/4 corner of said Section 1; thence S 0000'23'1 E, 1309.68 feet; thence
S 89050'18" E, 40.00 fedt to the easterly right-of-way of Redwood Street; thence
N 0'00'23" W, along said line, 308.55 feet to the POINT OF BEGINNING; thence,
continuing along said line,�N 0000'23" W, 611.45 feet to the Northwest corner of Tract P;
Thence N 90000'o0" E, along the north line of said Tract, 342.27 feet to a point on the
southwesterly Right-of-Way, of Willox Lane; Thence, along said Right-of-Way the
