HomeMy WebLinkAbout1990-081-06/05/1990-BURNS ANNEXATION INITIATING RESOLUTION 90- 81 OF THE COUNCIL OF THE CITY OF FORT COLLINS FINDING SUBSTANTIAL COMPLIANCE AND INITIATING ANNEXATION PROCEEDINGS FOR THE BURNS ANNEXATION WHEREAS, a written petition, together with four (4) prints of an annexation map, was heretofore filed with the City Clerk requesting the annexation of certain property to be known as the Burns Annexation; and WHEREAS, the Council of the City of Fort Collins desires to initiate annexation proceedings in accordance with law. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the Council of the City of Fort Collins hereby accepts the annexation petition for the Burns Annexation, more particularly described as situate in the County of Larimer, State of Colorado, to wit: A parcel of land situated in the Northeast 1/4 of Section 29, Township 7 North, Range 69 West of the 6th P.M. , Larimer County, Colorado, described as follows: All bearings contained herein are relative to the northerly line of Section 29 as bearing North 88°49'10" East. Commencing at the Northeast corner of Section 29, THENCE South 0°39'38" West, along the monumented easterly line of the Northeast 1/4 Northeast 1/4 of said Section, 1099.48 feet to the TRUE POINT OF BEGINNING; THENCE South 88°27' 14" West, along an east-west fence and its extension easterly, 1164.92 feet to a fence corner; THENCE South 87'16'51" West, along an east-west fence, 280.09 feet to a point on the water level traverse line of Dixon Canyon Reservoir, State Engineer's File No. 3120; THENCE along said line the following three (3) courses: (1) South 12°32'24" East, 658.20 feet; (2) South 5°02'24" East, 814.00 feet; (3) South 14°17'24" East, 61 .20 feet to a point on the southerly line of the Southeast 1/4 Northeast 1/4 of said Section; THENCE North 88051'37" East, along said line, 1197.65 feet to the East 1/4 corner of said Section, a BLM Brass Cap; THENCE North 0°38'44" East, along the monumented easterly line of said aliquot part, 1316.45 feet to the Northeast corner of said aliquot part, a No. 4 rebar with plastic cap, LS 10725; THENCE North 0039'38" East, along the monumented easterly line of the Northeast 1/4 Northeast 1/4 of said Section; 217. 19 feet to the TRUE POINT OF BEGINNING. Said parcel contains 45.647 acres, more or less. Section 2. That the Council hereby finds and determines that the annexation petition and accompanying map are in substantial compliance with the Municipal Annexation Act, and desires to initiate annexation proceedings in accordance with law. Section 3. That the Notice attached hereto be adopted as a part of this Resolution. Said Notice establishes the date, time and place when a public hearing will be held regarding the passage of an annexation ordinance pertaining to the above described property. The City Clerk is directed to publish a copy of this Resolution and said Notice as provided in the Municipal Annexation Act. Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this 5th day of June A.D. 1990 jjtQ�%ufiyt. ayor ATTEST \ 1 (a City Clerk NOTICE TO ALL PERSONS INTERESTED: PLEASE TAKE NOTICE that the City Council of the City of Fort Collins has adopted a Resolution initiating annexation proceedings for the Burns Annexation, said Annexation being more particularly described in said Resolution, a copy of which precedes this Notice. That, on July 17, 1990, at the hour of 6:30 p.m. , or as soon thereafter as the matter may come on for hearing in the Council Chambers in the City Hall , 300 Laporte Avenue, Fort Collins, Colorado, the Fort Collins City Council will hold a public hearing upon the annexation petition for the purpose of finding and determining whether the property proposed to be annexed meets the applicable requirements of Colorado law and is considered eligible for annexation. At such hearing, any persons may appear and present such evidence as they may desire. Dated this 5th day of June, A.D. 1990. City Clerk
