HomeMy WebLinkAbout1997-034-03/18/1997-AMENDING ACCESS CONTROL PLAN BETWEEN BOARDWALK DRIVE BETWEEN BOARDWALK DRIVE I-25 HARMONY ROAD/SH 68 RESOLUTION 97-34 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY MANAGER TO EXECUTE AN INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF FORT COLLINS AND THE STATE OF COLORADO, DEPARTMENT OF TRANSPORTATION, AMENDING THAT CERTAIN ACCESS CONTROL PLAN FOR HARMONY ROAD/SH 68 BETWEEN BOARDWALK DRIVE AND I-25 WHEREAS, on March 15, 1989,the Council of the City of Fort Collins authorized the City Manager to execute an Intergovernmental Agreement between the Colorado Department of Highways establishing an Access Control Plan for Harmony Road between Boardwalk Drive and I-25 ("the Access Agreement"); and WHEREAS, on October 7, 1996,the Fort Collins Planning and Zoning Board approved the Harmony Safeway Marketplace PUD,which PUD requires a right-in/right-out access along the north side of Harmony Road and approximately 840 feet east of Wheaton Drive; and WHEREAS,the proposed access along Harmony Road is not shown on the Harmony Road Access Plan and requires an amendment to the Access Agreement prior to the developer of the Harmony Safeway Marketplace PUD receiving an access permit; and WHEREAS, a traffic study prepared for the Harmony Safeway Marketplace PUD demonstrated to the satisfaction of the City's Traffic Engineer and the Colorado Department of Transportation that the inclusion of a right-in/right-out access point on the north side of Harmony Road approximately 840 feet east of Wheaton Drive would operate safely and improve the operating efficiency of the Harmony Road and McMurry Avenue intersection; and WHEREAS, the City Council has accordingly determined that the Harmony Road Access Control Plan should, in the interest of public safety, be amended to authorized the aforesaid right- in/right-out access point; and WHEREAS, the City Charter, at Article II, Section 16, provides that the Council may, by ordinance or resolution, enter into contracts for cooperative or joint activities with other governmental bodies. NOW, THEREFORE,BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the City Manager be,and hereby is,authorized to enter into an amendment agreement with the Colorado Department of Transportation for the purpose of amending the Access Agreement as approved by the City Council on March 15, 1989, to permit a right-in/right-out access for the north side of Harmony Road approximately 840 feet east of Wheaton Drive to be used in connection with the Harmony Safeway Marketplace PUD.
