OF THE COUNCIL OF THE CITY OF FORT COLLINS
OUTLINING THE BASIC PRINCIPLES TO BE CONTAINED IN AN
INTERGOVERNMENTAL AGREEMENT WITH LARIMER COUNTY
FOR THE PURPOSES OF ADDRESSING GROWTH MANAGEMENT ISSUES
WHEREAS, the City of Fort Collins and Latimer County entered into an Intergovernmental
Agreement for the Fort Collins Urban Growth Area in May 1980, as the formal mechanism to
manage growth in the area surrounding the City; and
WHEREAS, the Agreement was updated and revised in 1982, 1983, and 1988; and
WHEREAS, continued growth in the Fort Collins area suggests that increased coordination
between the City and the County can result in further improvement in management and control of
the development in the area surrounding the City; and
WHEREAS, the City has developed certain revisions to its Comprehensive Plan, known as
City Plan, including without limitation the Visions and Goals document, a City Structure Plan Map,
and a Principles and Policies document, and the County has developed certain revisions to its
Comprehensive Plan, known as the Partnership Land Use System (PLUS); and
WHEREAS, the revision of the Intergovernmental Agreement for the Fort Collins Urban
Growth Area will be instrumental in the successful implementation of both CITY PLAN and PLUS;
WHEREAS, it is imperative that the City and the County diligently pursue the development
of a new Agreement containing the principles outlined below; and
WHEREAS, it is the desire of the Council of the City of Fort Collins that the update and
renewal of its Intergovernmental Agreement with the County for growth management purposes be
completed as soon as possible but no later than March 1, 1997.
NOW, THEREFORE,BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the following basic principles be addressed in a revised Intergovernmental Agreement
with Latimer County for the purpose of addressing growth management issues:
1) Establishing an official Cooperative Planning Area, larger in size than the current
UGA boundary, in which the City can have a formal role in planning and growth
management activities.
2) Reviewing the current UGA boundary for consistency with CITY PLAN and PLUS
policies.
3) Regulating development into a compact pattern within well defined boundaries.
4) Ensuring that any system of transferrable development rights (TDR) adopted by the
County have as its primary objective the preservation of critical open lands that
would not otherwise be protected without special measures on the part of local
government.
5) Supporting physical development by an integrated framework of multi-modal
transportation alternatives that reduce dependency on the private automobile.
6) Establishing methods to improve the area's air quality as urban expansion occurs.
7) Preserving and protecting natural areas, foothills, and ridge lines from incompatible
development.
8) Providing well-defined urban edges with open lands which: a) help establish
community separators, b) regulate urban development patterns and location, and c)
preserve rural character areas.
9) Adopting annexation policies which will ensure that additional urban development
will occur in the city limits.
10) Establishing a"level playing field"for development,including common development
impact fees and comprehensive design standards for new development whether it
occurs within the City, the Urban Growth Area, or the Cooperative Planning Area.
11) Utilizing the provision of adequate public facilities and the phasing of infrastructure
installation for controlling the timing and location of development.
12) Requiring new development to pay its proportionate share of the cost of providing
the public services and facilities needed to offset its impacts.
13) Requiring existing development to assist in funding the cost of correcting existing
infrastructure deficiencies.
14) Requiring low density areas which utilize urban services to pay their proportionate
share of the cost of providing those services.
15) Developing a mechanism to measure the success or failure of the UGA as a growth
management tool.
16) Completing the revised Agreement by as soon as possible but no later than March 1,
1997.
