HomeMy WebLinkAbout1998-087-05/19/1998-AUTHORIZING THE PURCHASE OF APPROXIMATELY 17.5 ACRES OF LAND FOR NATURAL AREA PURPOSES AND THE LEASE RESOLUTION 98-87 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE PURCHASE OF APPROXIMATELY SEVENTEEN AND ONE-HALF ACRES OF LAND FOR NATURAL AREA PURPOSES AND THE LEASE OF PORTIONS OF SAID LAND TO EXISTING TENANTS FOR A TERM OF UP TO TWO YEARS WHEREAS, City staff has negotiated a proposed agreement to acquire, for natural area purposes,a seventeen and one-half acre parcel of land adjacent to the Poudre River,including a five- acre pond, which was previously used for gravel mining, which property is more particularly described in Exhibit"A,"attached hereto and incorporated herein by this reference(the"Property"); and WHEREAS, the Property has significant natural values and will help the City meet the objectives of the Natural Areas Policy Plan, the Parks and Recreation Policy Plan, and City Plan; and WHEREAS,the Property is immediately adjacent to the west ofthe County-owned McMurry Ponds Natural Area and adds to the complex of public lands in the immediate vicinity of the Poudre River, along with North Shields Pond Natural Area, McMurry Ponds, Hickory Park and Natural Area, Legacy Park and Natural Area, and Lee Martinez Park; and WHEREAS, the negotiated purchase price for the Property is $250,000, which reasonably represents the fair market value of the Property; and WHEREAS,funds sufficient to purchase and pay all related expenses in connection with the purchase, as described herein, have been appropriated and are available for expenditure; and WHEREAS,a portion of the Property is currently occupied and in use as mobile home sites for five mobile homes, as well as for pasturing one horse by a current resident, as shown on Exhibit "B", attached hereto and incorporated herein by this reference (the "Leased Areas"); and WHEREAS, in connection with the negotiation of the purchase by the City of the Property, City staff proposed that the current residents be permitted to remain tenants on the Leased Areas for a period of up to two years, in order to permit them to find alternative housing; and WHEREAS, City staff has negotiated leases with the current tenants on the Leased Areas, which would provide for payment by the tenants of monthly payments to the City of$175 to $225 per month, along with all utility expenses, and would provide for the purchase by the City of the mobile homes present on the Leased Areas for an amount of$10,000 each,upon termination of the leases, and would also permit the continued use of pasture land by one resident for her horse; and WHEREAS, City staff has been and continues to work with the Fort Collins Housing Authority, Neighbor to Neighbor, and other sources of housing assistance, to assist in the identification of alternative housing for the tenants on the Property; and WHEREAS, City staff has determined that the proposed leases of portions of the Property will be beneficial to the City,and will provide for a reasonable and fair opportunity for the relocation of the current residents; and WHEREAS, under Section 23-114 of the Code of the City of Fort Collins, the Council is authorized to lease any and all interests in real property owned in the name of the City,provided that Council first finds that the lease is in the best interests of the City. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. The City Manager is hereby authorized to purchase the Property described in Exhibit "A" for natural area purposes, and to execute such documents as may be necessary to complete such purchase. Section 2. That the City Manager is hereby authorized to enter into a lease agreement with each of the five current residents on the Property for their individual mobile home sites in the Leased Area, described on Exhibit "B", for a two year period, in exchange for a monthly rent payment in the amount of from $175 to $225 each, along with such other lease terms as the City Manager, in consultation with the City Attorney, determines appropriate or necessary to protect the interest of the City.
