OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING EXPENDITURES FROM THE ART IN PUBLIC PLACES RESERVE
ACCOUNT IN THE CULTURAL SERVICES AND FACILITIES FUND
AND THE ART IN PUBLIC PLACES RESERVE ACCOUNT
IN THE STORM DRAINAGE FUND
FOR THE COMMISSION OF AN ARTIST TO DESIGN AND
CREATE A LANDSCAPE SCULPTURE IN CONNECTION WITH
TIMBERLINE ROAD EXTENSION AND DRY CREEK CHANNEL IMPROVEMENTS
WHEREAS, Section 23-303 of the City Code, established the Art in Public Places Reserve
Account for use in the acquisition or leasing of works of art,maintenance,repair or display of works
of art, and administrative expenses related to the Art in Public Places Program, in accordance with
the Art in Public Places Guidelines adopted by Council in Ordinance No. 20, 1995 (the
"Guidelines"); and
WHEREAS,the City is currently proceeding with its Timberline Road Extension and Dry
Creek Channel Improvements Project (the"Project")to construct an extension of Timberline Road
north from Prospect Road to Summit View Road and Dry Creek Storm Drainage channel
improvements, along with related utility, pedestrian and other improvements; and
WHEREAS,the Timberline Road Extension Project is a road improvement project and one
percent (1%) of the funds from said project has been set aside in the Art in Public Places Reserve
Account in the Cultural Services and Facilities Fund for public art; and
WHEREAS, one percent (1%) of the funds that have been appropriated in the Dry Creek
Basin capital project account for the Dry Creek Channel Improvements Project,or$12,000,has been
proposed for transfer to the Art in Public Places Reserve Account in the Storm Drainage Fund,
through the adoption of Ordinance No. 164, 1997; and
WHEREAS, the Art in Public Places Board (the `Board") evaluated proposed works of art
for the Project in a competitive proposal process based on the Guidelines; and
WHEREAS,based on that evaluation,the Board selected the proposals of artist Robert Tully
to create a landscape sculpture comprised of a stone bench centered on ripple mounds and a 150 foot
masonry wall with wave and willow catkin shapes, at its September 18, 1997 meeting; and
WHEREAS,the estimated cost to create the proposed sidewalk art,including administration,
commission of the artists,contingency and maintenance of the pieces is Seventy-eight Thousand Six
Hundred and Seventy Dollars ($78,670); and
WHEREAS,adequate funds are available in the Art in Public Places Reserve Account in the
Cultural Services and Facilities Fund and, upon final adoption of Ordinance No. 164, 1997, in the
Art in Public Places Reserve Account in the Storm Drainage Fund for 1997 to provide for the
commission of Robert Tully to create the landscape sculpture; and
WHEREAS, the Guidelines require that the Council approve the Board's selection of public
art.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the expenditure of up to Sixty Six Thousand Six Hundred and Seventy Dollars
($66,670) from the Art in Public Places Reserve Account in the Cultural Services and Facilities
Fund, and, contingent upon the final adoption of Ordinance No. 164, 1997, up to Twelve Thousand
Dollars($12,000) from the Art in Public Places Reserve Account in the Storm Drainage Fund, for
the landscape sculpture proposed by artist Robert Tully,the conceptual design of which was selected
and approved by the Art in Public Places Board on September 18, 1997, is hereby authorized.
