HomeMy WebLinkAbout1997-008-01/21/1997-CITY OF LOVELAND IGA LARIMER COUNTY REGIONAL BUS SERVICE RESOLUTION 97-8 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY MANAGER TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH THE CITY OF LOVELAND AND LARIMER COUNTY TO PROVIDE REGIONAL BUS SERVICE BETWEEN FORT COLLINS AND LOVELAND WHEREAS, the City of Fort Collins operates a fixed route bus system (Transfort) offering citizens a safe, dependable alternative mode of transportation to various locations throughout the City; and WHEREAS, pursuant to the federal Urban Mass Transportation Act of 1964, as amended, and the federal Intermodal Surface Transportation Efficiency Act of 1991, the City of Fort Collins is required to adopt a comprehensive program for the development and extension of mass transit programs in order to receive federal funds in support of transit projects; and WHEREAS, on March 5, 1996, the City Council approved Resolution 96-16, adopting the City's Transit Development Plan (TDP) for the years 1996 through 2002; and WHEREAS, the TDP provides a seven-year plan, with local and regional components, for providing public and specialized transit services in Fort Collins (local) and Loveland and rural Larimer County (regional); and WHEREAS, within the regional plan, sufficient interest has been shown to warrant the establishment of fixed-route bus service on U.S. Highway 287 between Fort Collins and Loveland; and WHEREAS, representatives from the City of Fort Collins,the City of Loveland, and Larimer County have made presentations to City Councils of Fort Collins and Loveland, the Larimer County Commissioners, and the City's Transportation Board to discuss a plan to provide bus service between Fort Collins and Loveland; and WHEREAS, the City has determined that Transfort has the capacity to provide fixed route service between Fort Collins and Loveland at a cost of$231,120; and WHEREAS, funding for a fixed route between Fort Collins and Loveland for the year 1997 has been identified as follows: City of Fort Collins - Community Opportunity Investments $ 55,000 City of Loveland 55,000 Larimer County 76,790 Fares 44,330 Total $ 231,120 WHEREAS, the agreement provides for equal sharing among the parties of the costs of providing the bus service in future years; and WHEREAS, in accordance with the terms of the proposed agreement,the City of Fort Collins will receive funds from the City of Loveland and Larimer County; and the City, through Transfort, will provide the equipment and personnel needed to provide fixed route service which will run from a designated stop in Loveland to the existing Transfort system in Fort Collins along the U.S. Highway 287 corridor; and WHEREAS,for the aforesaid reasons,the Council of the City of Fort Collins has determined that it is in the best interest of the citizens of the City that fixed route bus service be provided between Fort Collins and Loveland; and WHEREAS, Article II, Section 16 of the City Charter provides that the Council may enter into agreements with other governmental bodies for the performance of cooperative or joint activities. NOW,THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the City Manager be,and hereby is,authorized to enter into an agreement with the City of Loveland and Larimer County for the provision of fixed route bus service between Fort Collins and Loveland, and within Loveland, which agreement shall include the following terms, and such other terms not inconsistent with the following as the City Manager may deem necessary to protect the interests of the City: a. The City of Fort Collins (Transfort) will provide the equipment and personnel for the fixed route which will run from a designated stop in Loveland to the existing Transfort system in Fort Collins along the U.S. Highway 287 corridor. b. The initial fare for this service will be$1.50; however, there may be an introductory period of up to six weeks during which no fare will be charged to promote the use of the service, and the City of Fort Collins will be able to modify the fare by up to fifty percent (50%) with advance notice to the County and the City of Loveland. C. Passengers will be able to transfer to other routes in the Transfort system at no additional charge. d. The City of Fort Collins will operate this service in accordance with applicable Transfort schedules, policies and procedures, and will have the discretion to make alterations to the service in order to improve its efficiency or effectiveness. e. The parties shall contribute the following amounts toward the cost of operation of the bus service during 1997: City of Fort Collins $ 55,000 City of Loveland 55,000 Larimer County 76,790 f. The Agreement shall extend through December 31, 1997, with the provision for four (4) one-year extensions. g. The Agreement shall further indicate that it is the parties' intent that the cost of providing the service in future years be shared equally among them. Section 2. That the City Manager may, if he deems it to be in the best interests of the City, extend the Agreement for up to four (4) additional years (through 2001) and make such modifications to the Agreement, or any extension thereof, as he may, after consultation with the City Attorney, consider necessary to protect the City's interest and advance the efficient and effective provision of bus service between Fort Collins and Loveland.
