HomeMy WebLinkAbout1996-083-07/16/1996-PHASING CRITERIA PUBLIC STREET CAPACITY TERRY SHORES NORTH PUD UGA AGREEMENT WAIVER RESOLUTION 96-83 OF THE COUNCIL OF THE CITY OF FORT COLLINS RECOMMENDING COUNTY APPROVAL OF A WAIVER OF THE PUBLIC STREET CAPACITY PHASING CRITERIA OF THE UGA AGREEMENT FOR THE TERRY SHORES NORTH PUD WHEREAS, the Intergovernmental Agreement for the Fort Collins Urban Growth Area between the City of Fort Collins and Latimer County (the "UGA Agreement"), which establishes the Fort Collins Urban Growth Area(the"UGA"),provides that the City Council shall have the right to review and comment upon development proposals which request waivers to the phasing criteria for development within the UGA; and WHEREAS,Latimer County has forwarded to the City for its review and comment a waiver request for the Terry Shores North PUD ("the Development") whereby it has been requested that a waiver be granted with respect to the public street capacity phasing criteria as set forth in the UGA Agreement; and WHEREAS, the Development is located within the UGA and qualifies as an "in-fill" development in accordance with the UGA Agreement and, therefore, is eligible for consideration of a waiver of the phasing criteria requirement for public street capacity; and WHEREAS,the requested waiver will not jeopardize the public health, safety or welfare and the intent and purposes of the UGA Agreement will not be compromised by the granting of such waiver. NOW,THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS, that the Council hereby recommends to the Board of County Commissioners that the requirements of the UGA with respect to the public street capacity phasing criteria, as defined in the Latimer County Special Supplement Regulations, be waived as that requirement is or may be applicable to the Development on the condition that the applicant for the waiver, Terry Cove, Inc., be required by the County to contribute to the cost of designing and constructing off-site street improvements at the intersection of County Road 54 and State Highway 1 by paying the greater of: (1) Seven Hundred Dollars ($700) per lot in the Development, or (2) Terry Cove, Inc.'s proportionate share of the total cost of such improvements as determined by the County.
