HomeMy WebLinkAbout1996-070-06/11/1996-CHOICES 95 CAPITAL STREETS PROSPECT TO SUMMITVIEW TIMBERLINE EXTENSION RESOLUTION 96-70 OF THE COUNCIL OF THE CITY OF FORT COLLINS CONCERNING THE IMPLEMENTATION OF THE "TIMBERLINE EXTENSION-PROSPECT TO SUMMITVIEW" CHOICES 95 CAPITAL STREETS PROJECT WHEREAS, on May 1, 1984, the electors of the City of Fort Collins approved the passage of Ordinance No. 30, 1984, which imposed a 1/4 cent Sales and Use Tax for the purpose of generating revenue for certain specified capital projects, including the acquisition of right-of-way for the extension of Timberline Road from Prospect to Summit View; and WHEREAS, from 1985 through 1987, Seven Hunched Seventy-nine Thousand Dollars ($779,000.00) was appropriated by the Fort Collins City Council (the "Council")for the acquisition of such right-of-way; and WHEREAS, in October of 1987, the Council adopted Resolution 87-130 by which it established an Executive Committee and four subcommittees made up of appointed citizen volunteers whose task it was to develop a prioritized list of Choices 95 capital projects and submit this list, through the Executive Committee, to the Council; and WHEREAS, in October of 1988, the Executive Committee submitted its final recommendations to the Council in the Committee's "City of Fort Collins Choices 95 Executive Committee Final Report" dated October 7, 1988 (the "Final Report"); and WHEREAS, on January 3, 1989, the Council, after reviewing the Final Report and receiving public input, adopted Resolution 89-5 which submitted Ordinance No. 9, 1989, to the City's voters, which Ordinance proposed a new quarter-cent sales and use tax for the purpose of raising revenue for the Choices 95 projects and imposed the tax beginning January 1, 1990, to expire on December 31, 1997; and WHEREAS, Ordinance No. 9, 1989, was submitted to the voters at the March 7, 1989 election and was approved by a majority of the voters (the "initiated Ordinance"); and WHEREAS, Section 2 of the Initiated Ordinance lists three general categories of Choices 95 projects to be built using the levied sales and use tax; and WHEREAS, one of the three categories is for street and transportation capital projects including one project identified as the "Timberline Extension - Prospect to Summitview" ("the Timberline Project"); and WHEREAS, on November 7, 1995, the Council adopted Ordinance No. 134, 1995, establishing the City's annual budget and appropriations for the 1996 fiscal year ("the 1996 Appropriation Ordinance."); and WHEREAS, the 1996 Annual Appropriation Ordinance appropriated"Two Million Twenty Thousand Dollars ($2,020,000) to be used, together with previously appropriated funds, for the construction of the Timberline Project; and WHEREAS, the monies appropriated for the Timberline Project have been only partially expended, and questions have been raised about the advisability of proceeding with the Project as contemplated in the Initiated Ordinance; and WHEREAS, over the past six months, City staff and City consultants have conducted extensive public outreach and have conducted conceptual design studies concerning the desirability of proceeding with the Timberline Project as contemplated in the Initialed Ordinance; and WHEREAS, the results of this public outreach and these studies have been presented to the Council for its consideration; and WHEREAS, after considering such information and receiving additional public input, the Council has determined that it is in the best interests of the City and its citizens to proceed with the construction of the Timberline Project by extending Timberline from Prospect to Summit View as approved by the voters in the Initiated Ordinance; and WHEREAS, it is anticipated that sufficient revenues will be available from the Choices 95 sales and use tax to fund the construction of the Timberline Project from Prospect to Summit View and to mitigate the impacts of the Project. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS, as follows: Section 1. That City staff is hereby directed to proceed with the design work and right-of- way acquisition for the Timberline Project and that the extension of Timberline shall be from Prospect to Summit View. Section 2. That upon completion of the design of the Timberline Project and prior to undertaking any construction work on the Project, the City Manager shall present for Council's consideration: (a) an estimate of the total cost of the Project, including the cost of mitigating the impacts of the Project; and (b) such ordinances as may be necessary to appropriate the additional funds needed to complete the Project and mitigate its impacts.
