HomeMy WebLinkAbout1996-063-05/21/1996-L L JOHNSON DISTRIBUTING CO ROTARY MOWER SOLE SOURCE PURCHASE RESOLUTION 96-63 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING THE PURCHASE OF A TORO 580D ROTARY MOWER FROM L. L. JOHNSON DISTRIBUTING CO. AS AN EXCEPTION TO THE COMPETITIVE PURCHASING PROCESS WHEREAS, the City Parks and Recreation Department needs a large rotary mower with a short wheelbase for tight turning during trim mowing operations, excellent visibility for transport and trinuning, clean, windrow-free mowing capability in tall grass, versatile enough to handle snow removal equipment, and with a low center of gravity to allow safe operation on sloping terrain and Shut off of powered implements with a single action; and WHEREAS, based on recent review and evaluation of available mowing equipment, the Purchasing Agent has determined that Toro makes the only rotary mower, the Toro 580D mower, meeting all of these requirements, and WHEREAS, sufficient funds for the purchase of the'foro 580D mower have been budgeted by Parks Maintenance; and WHEREAS, Section 8-160 (d) (1) b. of the Code of the City of Fort Collins authorizes the Purchasing Agent to negotiate the purchase of supplies and service without utilizing a competitive process where the Purchasing Agent determines that although a particular material or service is available from more than one (1) responsible source, a competitive process cannot reasonably be used, or, if used, will result in a substantially higher cost to the city, will otherwise injure the city's financial interests or will substantially impede the city's administrative functions of the delivery of services to the public; and WHEREAS, the Purchasing Agent has determined that due to these numerous advantages offered by the 580D, and the failure of other available mowing equipment to meet the City's requirements, the Purchasing Agent has determined that a competitive process cannot reasonably be used and, if used, would result in a substantially higher cost to the city and may result in the impairment of the city's delivery of services to the public, and the Purchasing Agent has submitted the requisite justification for this determination to the City Manager for approval; and WHEREAS, the City Manager has reviewed and approved the justification for this acquisition; and WHEREAS, Section 8-160 (d) (3) requires approval of this purchasing method by the City Council for items costing more than Fifty Thousand Dollars ($50,000)prior to acquisition. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS that the Purchasing Agent is authorized to purchase a Toro 580D rotary mower from L. L. Johnson Distributing Co. in the amount of$55,577 as an exception to the competitive purchasing process requirements.
