HomeMy WebLinkAbout2000-012-01/18/2000-AMENDING RESOLUTION 99-105 PERTAINING TO THE IGA CONCERNING THE CACHE LA POUDRE COMMISSION RESOLUTION 2000-12 OF THE COUNCIL OF THE CITY OF FORT COLLINS AMENDING RESOLUTION 99-105 PERTAINING TO THE INTERGOVERNMENTAL AGREEMENT CONCERNING THE CACHE LA POUDRE COMMISSION WHEREAS,on August 17, 1999,the Council of the City of Fort Collins passed and adopted Resolution 99-105 authorizing the Mayor to execute an Intergovernmental Agreement (the "Agreement") among Larimer County, Weld County and the cities of Fort Collins, Loveland and Greeley concerning the Cache La Poudre Commission; and WHEREAS,subsequent to the adoption of said Resolution 99-105,Larimer County prepared an amendment to the form of the Agreement that had been approved by the Council; and WHEREAS,the proposed Agreement, as revised by Larimer County, has been found to be acceptable by the Council of the City of Fort Collins; and WHEREAS, the revised form of the Agreement is acceptable to the City Council. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That Resolution 99-105 is hereby amended so the Mayor is authorized to execute the revised form of the Agreement as shown on Exhibit "A", attached hereto and incorporated herein by this reference. Section 2. That the form of the Agreement shown on Exhibit "A" shall replace and supersede the form of the Agreement originally shown on the Exhibit "A" which was attached to Resolution 99-105. Section 3. That the form of the Agreement may be further revised by the Mayor, upon consultation with the City Manager and the City Attorney, as necessary to effectuate the intent and purposes of said Agreement. Passed and adopted at a regular meeting of the City Council held this 18th day of January, A.D. 2000. Mayor ATTEST: City Clerk EXHIBIT "A" MEMORANDUM OF UNDERSTANDING BETWEEN LARIMER COUNTY, WELD COUNTY,AND THE CITIES OF FORT COLLINS, LOVELAND AND GREELEY, CONCERNING THE CACHE LA POUDRE COMMISSION Whereas, the Cache la Poudre River Corridor Act (The Act), Public Law 104-323, was enacted by the Congress in October 1996, with its mission to be carried out by a citizen commission(The Commission), and Whereas, the mandate of The Act, under the direction of The Commission, is to develop an interpretive plan for this river corridor, and Whereas, technical problems with the language of The Act have delayed the appointment of The Commission, and Whereas, a previous Memorandum of understanding between Weld County, Larimer County and the National Park Service allows the Park Service to cooperate with the local entities on the pre- planning processes for implementing the Act, and Whereas, Larimer County, Weld County, and the cities of Fort Collins, Loveland and Greeley, wish to expedite the will of Congress and of local communities in implementing the mission of the Poudre Corridor Act, and Whereas, each entity has previously recommended individuals for appointment to the Commission, as outlined in the Cache La Poudre Corridor Act. Now, therefore, Larimer County, Weld County, and the cities of Fort Collins, Loveland and Greeley, desire, as an interim measure to forward the purposes of the Cache La Poudre River Corridor Act, in cooperation with the National Park Service. The above parties agree as an interim measure to forward the purposes of the Cache La Poudre River Corridor Act to develop and expand the exchange of information developed in the previous mou, to continue the coopration with the National Park Service, and to proceed with the work of the Cache La Poudre River Corridor Act until the commission is officially appointed.
