OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING EXPENDITURES FROM THE ART IN PUBLIC PLACES
RESERVE ACCOUNT IN THE STORM DRAINAGE UTILITY FUND TO
COMMISSION AN ARTIST TO CREATE WATER QUALITY BOXES
WHEREAS, Section 23-303 of the City Code established the Art in Public Places Reserve
Accounts in the Light and Power, Water, Wastewater and Storm Drainage Funds for use in the
acquisition or leasing of works of art, maintenance, repair or display of works of art, and
administrative expenses related to the Art in Public Places Program, in accordance with the Art in
Public Places Guidelines adopted by the City Council in Ordinance No.20, 1995(the"Guidelines");
and
WHEREAS,as part ofthe recent constructionof the Mitchell Block at Mountain Avenue and
Walnut Street, the developer installed a new on-street parking surface consisting of porous block
pavers over a gradient medium of crushed stone,which filters runoff before it enters the storm sewer
system; and
WHEREAS, the Stormwater Utility, in partnership with Colorado State University, is
monitoring the effectiveness of this new approach to water quality treatment, and as part of the
monitoring process wishes to install in the Old Town area two water quality boxes that will house
and protect the equipment needed for testing the water quality of stormwater runoff(the"Project");
and
WHEREAS, the Stormwater Utility has completed a number of projects that did not offer
appropriate sites for Art in Public Places projects; and
WHEREAS, one percent of the funds from such projects has been set aside in the Art in
Public Places reserve account in the Storm Drainage Utility Fund, and the Stormwater Utility
proposed that a portion of those funds be used for artwork to enhance the Project; and
WHEREAS, the Art in Public Places Board (the "Board") selected an artist for the Project
from the APP Design Consultant Resource List; and
WHEREAS, artist Andrew Dufford(the"Artist")was selected to develop a design concept
for the Project that would fit into the Old Town location and meet the goals of the Project while
adding educational and artistic components to the Project; and
WHEREAS,the Board evaluated the Artist's final design at its regular meeting on February
17, 2010, pursuant to the Guidelines; and ,
WHEREAS,based on that evaluation, the Board is recommending the Artist's proposal for
two patterned steel boxes that will graphically represent the flow of water through the filtration
medium, with water-related quotations that will wrap around the lids of the boxes and bronze cars
mounted on the tops of the boxes; and
WHEREAS,the estimated cost to create the Project,including design,materials,installation
and contingency, is $39,500; and
WHEREAS, those funds are available in the Art in Public Places reserve account in the
Storm Drainage Utility Fund and are appropriated as part of the 2011 budget to be spent on the
Project; and
WHEREAS, Section 23-308 of the City Code requires that the Board selection of the
recommended art be presented for City Council review and approval, because the cost of the art
exceeds $10,000; and
WHEREAS, Section 23-303 of the City Code states that monies credited to Utility Art in
Public Places reserve accounts shall be expended only for the acquisition of works of art that provide
a betterment to such utility or that are otherwise determined by the City Council to be for a specific
utility purpose that is beneficial to the rate payers of such utility.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the proposed Project provides a betterment to the Stormwater Utility.
Section 2. That the City Council hereby authorizes the expenditure of up to THIRTY
NINE THOUSAND FIVE HUNDRED DOLLARS ($39,500)from the Art in Public Places reserve
account in the Storm Drainage Utility,Fund for the Project proposed by Andrew Dufford, the
conceptual designs for which were reviewed and approved by the Art in Public Board on February
17, 2010.
Passed and adopted at a regular meeting of the Council e City of Fort Collins this 15th
day of March A.D. 2011.
