HomeMy WebLinkAbout2011-034-04/19/2011-AUTHORIZING THE LEASE OF CITY-OWNED PROPERTY AT 200 WEST MOUNTAIN AVENUE, SUITE A, TO BEET STREET FO RESOLUTION 2011-034 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE LEASE OF CITY-OWNED PROPERTY AT 200 WEST MOUNTAIN AVENUE, SUITE A, TO BEET STREET FOR UP TO TWO YEARS WHEREAS, the City is the owner of the property located at 200 West Mountain Avenue, Suite A, Fort Collins, Larimer County, Colorado (the "Property"); and WHEREAS, from 2004 to 2010 the City purchased the Property in furtherance of the Civic Center Master Plan and has not yet finalized specific plans for the Property; and WHEREAS,the Property was leased by the City as part of the Rocky Mountain Innosphere (formerly RMI2) program but it is now vacant; and WHEREAS, Beet Street, a non-profit organization,needs a larger facility for the operation of its arts and cultural center for a period of approximately one year, after which period of time it plans to move into the City's Carnegie Building, subject to City Council approval of a lease for that space; and WHEREAS, City staff has determined that the Property would be an appropriate facility for Beet Street to rent; and WHEREAS,because of the public benefit provided by Beet Street;and its non-profit status, City staff is recommending that Beet Street not be charged rent for its use of the Property; and WHEREAS, Beet Street would be required to pay its share of utilities for the Property; and WHEREAS, under Section 23-114(a) of the City Code, the City Council is authorized to lease, for a definite term of two years or less, any and all interests in real property owned in the name of the City,provided that t the City Council first finds,by resolution,that the lease is in the best interests of the City. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: Section 1. That the City Council hereby finds that leasing the Property to Beet Street for up to two years under the terms listed above is in the best interests of the City. Section 2. That the City Manager is hereby authorized to execute a lease agreement consistent with the terms of this Resolution, together with such additional terms and conditions as the City Manager, in consultation with the City Attorney,determines to be appropriate to protect the interests of the City or effectuate the purposes of this Resolution, including any necessary changes to the description of the Property, as long as such changes do not materially increase the size or change the character of the property to be leased.
