HomeMy WebLinkAbout2012-094-10/16/2012-AUTHORIZING THE CITY MANAGER TO ENTER INTO A GRANT AGREEMENT WITH COLORADO PARKS AND WILDLIFE FOR TH RESOLUTION 2012-094 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE CITY MANAGER TO ENTER INTO A GRANT AGREEMENT WITH COLORADO PARKS AND WILDLIFE FOR THE FOSSIL CREEK TRAIL AT EAST TRILBY ROAD WHEREAS, in October, 2010, the City's Park Planning staff applied for a Non- Motorized State Trails Program Grant from the State of Colorado, Department of Natural Resources, Division of Parks and Wildlife(the "State"); and WHEREAS, in 2012 the State approved the City's grant application and awarded the City a $200,000 trail grant funded by the National Park Service (the "Grant') for the completion of the Fossil Creek Trail at East Trilby Road (the "Project"); and WHEREAS, the total cost of the Project is estimated to be approximately $890,000; and WHEREAS, the City's share of the Project Cost, approximately $690,000, is available in the Conservation Trust Fund and the Natural Area trail program; and WHEREAS, in order to receive the Grant funds, the City must enter into a grant agreement with the State; and WHEREAS, the City is authorized to enter into intergovernmental agreements, such as a grant agreement, to provide any function, service or facility, under Article II, Section 16 of the Charter of the City of Fort Collins and Section 29-1-203, C.R.S.; and WHEREAS, the grant agreement, a copy of which is on file in the office of the City Clerk and available for public inspection (the "Grant Agreement"), requires the City to complete the Project by December 31, 2014; to comply with applicable federal regulations; to make certain reports to the State; and to provide, upon request, proof of the City's authority to enter into the Grant Agreement; and WHEREAS, City staff recommends that the City Council approve the Grant Agreement as described herein. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the City Manager is hereby authorized to enter into the Grant Agreement with the State obligating the City to use the $200,000 in Grant proceeds for the construction of the Fossil Creek Trail at East Trilby Road, in substantially the form of agreement that is on file in the office of the City Clerk, and that the terms of the Grant Agreement are approved together with such other terms and conditions as the City Manager, in consultation with the City Attorney, determines to be necessary and appropriate to protect the best interests of the City.
