OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING EXPENDITURES FROM THE ART IN PUBLIC PLACES
RESERVE ACCOUNT IN THE CULTURAL SERVICES AND FACILITIES FUND
TO COMMISSION AN ARTIST TO CREATE ART FOR
THE NORTH COLLEGE IMPROVEMENT PROJECT
WHEREAS,the City is in the process of constructing the North College Improvement Project
(the "Project"); and
WHEREAS, pursuant to Sections 23-303 and 23-304 of the City Code, one percent of the
funds appropriated for the Project was set aside in the Art in Public Places reserve account in the
Cultural Services and Facilities Fund for use in the acquisition or leasing of works of art, the
maintenance, repair or display of works of art, and administrative expenses related to the Art in
Public Places Program, in accordance with the Art in Public Places Guidelines adopted by the City
Council in Ordinance No. 047, 1998 (the "Guidelines"); and
WHEREAS,the North College Project Team selected artist Andy Dufford of Chevo Studios
(the "Artist") from the APP Design Consultant Resource List to work with the Project Team,
including representatives from the North College Business Association,to develop design concepts
appropriate to the Project site; and
WHEREAS, the Art in Public Places Board (the "Board") evaluated the Artist's designs at
its regular meeting on February 25, 2012, pursuant to the Guidelines; and
WHEREAS, based on that evaluation, the Board is recommending the Artist's proposal for
five artworks for the Project site consisting of stone and metal monuments with medallion designs
drawn from the natural history of the Poudre River,which will also provide illumination and identify
block numbers for wayfinding (the "Art Project"); and
WHEREAS, the estimated cost to create the Art Project, including design, materials,
installation and contingency for the Art Project, is $87,092; and
WHEREAS, $68,025 of the funds for the Art Project is available in the Art in Public Places
reserve account in the Cultural Services and Facilities Fund and has been appropriated as part of the
2012 budget, while the remaining $19,067 will be paid by the Project and has been appropriated in
the Project budget; and
WHEREAS, the funds described above will be used to provide for the Artist's design fees,
materials, installation and contingency for the Art Project; and
WHEREAS, Section 23-308 of the City Code requires that the Board's selection of the
recommended art be presented for Council review and approval because the cost of the art exceeds
$10,000.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City Council hereby authorizes the expenditure of up to EIGHTY SEVEN
THOUSAND NINETY TWO DOLLARS ($87,092), consisting of SIXTY EIGHT THOUSAND
TWENTY FIVE DOLLARS($68,025)from the Art in Public Places reserve account in the Cultural
Services and Facilities Fund and NINETEEN THOUSAND SIXTY SEVEN DOLLARS ($19,067)
from the Project budget,for the Art Project proposed by the Artist,the conceptual designs for which
were reviewed and approved by the Art in Public Places Board on January 25, 2012.
Passed and adopted at an adjourned meeting of the Council of the City of Fort Collins this
26th day of June A.D. 2012.
