OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING THE ACCEPTANCE OF THE PROPOSED DONATION
OF ARTWORK ON GRANITE PAVERS FROM THE
DOWNTOWN DEVELOPMENT AUTHORITY
WHEREAS,the Downtown Development Authority(DDA),in collaboration with the City,
is currently working on improvements to two alleys in the downtown area, with additional similar
projects planned in the near future (the "Alley Enhancement Projects"); and
WHEREAS, as part of the Alley Enhancement Projects, the DDA commissioned artists to
create artworks for the Projects, in a manner similar to the City's Art in Public Places Program;and
WHEREAS, one of artworks consists of sixty granite pavers etched with drawings created
by local youth, whose drawings were selected using an RFP process through the City's Purchasing
Department (the "Artwork"); and
WHEREAS, the DDA is paying all costs associated with the creation and installation of the
Artwork, with the goal of placing the Artwork in the City alley rights-of-way during work on the
Alley Enhancements Projects; and
WHEREAS, in order for the Artwork to be placed on City Property, the DDA wishes to
donate the Artwork to the City; and
WHEREAS, the value of the Artwork is estimated at $15,000; and
WHEREAS, as a condition of the City's acceptance of the donation,the DDA would agree
to assign any rights it has in the Artwork to the City, and to be responsible for the future costs of
maintenance, repair and, if appropriate, replacement of the Artwork; and
WHEREAS, Section 23-309 of the City Code requires that works of art with a value of$300
or more donated to the City to be placed in a public area may be accepted only with approval of the
Art in Public Places Board (the"APP Board"), and all such works with a value of$10,000 or more
may be accepted only with approval of the City Council, upon review of the proposed donation and
the recommendation of the APP Board; and
WHEREAS,at its regular meeting on May 19,2010,the APP Board evaluated the proposed
donation of the Artwork based on the City's Art in Public Places Guidelines and recommended that
the City Council accept the donation.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS,that the City Council hereby accepts the proposed donation of the etched granite pavers
featuring drawings by local youth, to be placed in City alley rights-of-way as part of the Alley
Enhancement Projects, as approved by the APP Board at its meeting on May 19, 2010.
Passed and adopted at a regular meeting of the Council of the City of Fort Collins this 17th
day of August A.D. 2010.
