HomeMy WebLinkAbout2010-048-08/17/2010-AUTHORIZING THE EXECUTION OF AN AMENDMENT TO THE INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF FOR RESOLUTION 2010-048 OF THE COUNCIL OF THE CITY OF FORT COLLINS AUTHORIZING THE EXECUTION OF AN AMENDMENT TO THE INTERGOVERNMENTAL AGREEMENT BETWEEN THE CITY OF FORT COLLINS AND THE COLORADO DEPARTMENT OF TRANSPORTATION FOR THE DESIGN AND CONSTRUCTION OF THE SOUTH TRANSIT CENTER WHEREAS,the Mason Corridor/MAX Bus Rapid Transit(BRT)Project includes within its scope the construction of a South Transit Center to function as a"Park-n-Ride"passenger drop-off and southern terminal for the MAX BRT service; and WHEREAS, the South Transit Center will be located in the approximate vicinity of the intersection of Fairway Lane and Fossil Boulevard; and WHEREAS, in 2009, the City entered into an intergovernmental agreement with the Colorado Department of Transportation for the funding of the preliminary design of the South Transit Center(the "Intergovernmental Agreement), which design has now been completed; and WHEREAS, the City is now ready to complete the final design and the construction of the South Transit Center utilizing funding from the Colorado Department of Transportation in the amount of$3,788,000,together with City local matching contributions from Site Land Value, BOB intersection funds and transit funds in the amounts of $545,487, $285,000, and $116,525, respectively, for a total capital cost of$4,735,000; and WHEREAS, the South Transit Center project was included in a National Environmental Policy Act Environmental Assessment, which assessment found that there was no significant environmental impact resulting from the construction and operation of the South Transit Center;and WHEREAS, City staff has conducted significant public outreach regarding the design and construction of the South Transit Center,and the Transportation Board has approved the design and construction of the South Transit Center as a part of its approval of the Mason Street Corridor Master Plan; and WHEREAS, the City Council has determined that it is in the best interests of the City that the amendment to the Intergovernmental Agreement for the design and construction of the South Transit Center should be authorized and approved. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the Mayor is hereby authorized to execute an Amendment to the Intergovernmental Agreement with the Colorado Department of Transportation in substantially the form of the "Contract Amendment to the Intergovernmental Agreement for the Design and Construction of the South Transit Center" that is on file in the office of the City Clerk, with such additional terms and conditions as the City Manager, in consultation with the City Attorney, deems necessary or appropriate to protect the interests of the City or to effectuate the purposes of this Resolution.
