HomeMy WebLinkAbout1979-035-04/17/1979-CREATING A UTILITY APPEALS COMMITTEE RESOLUTION 79-35 OF THE COUNCIL OF THE CITY OF FORT COLLINS CREATING A UTILITY APPEALS COMMITTEE WHEREAS, notwithstanding the fact that each of the Municipal utilities operating within the City of Fort Collins have administrative procedures designed to permit a customer to contest the discontinuance of utility services, it is believed to be desirable for the City to have a formal appeals process outside the affected department, and WHEREAS, it is believed such an appeal can be heard and decided by senior members of the City staff sitting in a quasi-judicial capacity NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows Section 1 A Utility Appeals Committee is hereby created, which shall consist of the following four members The Director of Finance Director of Light and Power Department Director of Water and Sewer Department Section 2. The Utility Appeals Committee shall hear all appeals filed by customers of the City utility relating to delinquency notices and notices of intent to discontinue services. Such protests shall be filed in accordance with the rules and regulations of the utility departments of the City and this Resolution Section 3 The Director of Finance shall receive any appeals to the Utility Appeals Committee Upon receipt of any such protest, the City Clerk shall schedule a meeting of the Utility Appeals Committee within forty-eight (48) hours from the date of receipt of the appeal and shall notify the members of the Committee and the customer filing the appeal as to the time, date and place of hearing Section 4. At the time set for the hearing, the Utility Appeals Committee shall meet and shall hear all evidence presented by the customer and the utility involved The Committee shall determine whether service to the customer shall be discontinued or continued and under what conditions The decision of the Committee shall be final. Section 5. A majority of the Committee shall constitute a quorum and a majority of the quorum shall be required for any action taken by the Committee Any member of the Committee may designate a representative from J his or her department as an alternate member with full authority to act in his or her place. Section 6 The Utility Appeals Committee, subject to Council approval, may adopt such bylaws or other rules and regulations governing the conduct of its business as it, from time to time, deems necessary or desirable.
